NOTICE OF DISSOLUTION AND CONTINUANCE OF NEW PARTNERSHIP.

NOTICE is hereby given that the Partnership heretofore subsisting between JOHN McARDLE, ARCHIE WILLIAM PLANK, and JOHN MILNE MIDDLETON, carrying on the business of Vinegar-manufacturers at No. 25 Riddiford Street, Wellington, under the style or firm name of “J. McArdle and Co.,” has been dissolved as from the 30th day of June, 1931.

The said John McArdle and the said Archie William Plank will continue to carry on business in Partnership together at No. 25 Riddiford Street, Wellington, under the firm name of “J. McArdle and Co.”

In the matter of the Religious, Charitable, and Educational Trusts Act, 1908, and its amendments, and in the matter of a Bequest of £10,000 under the Will of FRANCES MARY MARSDEN to the Nelson Diocesan Trust Board : Between THE NELSON DIOCESAN TRUST BOARD, incorporated under the Religious, Charitable, and Educational Trusts Act, 1908, and its amendments, having its registered office situate in the City of Nelson (Plaintiff), and THE ATTORNEY-GENERAL, of Wellington (Defendant).

WHEREAS Frances Mary Marsden, who died on the 12th day of March, 1918, bequeathed to the Nelson Diocesan Trust Board the sum of £10,000 upon trust “towards the cost of the erection of the spire or main spire (if there be more than one) of the new Church of England Cathedral to be erected in the City of Nelson, such spire to be called “the Frances Charters Marsden Spire” :

And whereas the said bequest is now in the hands of the plaintiff Board and amounted at the 31st day of March, 1931, with accumulated interest to £14,270 :

And whereas it has become impracticable or inexpedient to carry out the said trust upon which the said bequest is held, and the plaintiff desires that part thereof should be disposed of in rendering that portion of the new Cathedral now erected fit for use for worship : Now this is to notify all whomsoever it may concern that on Monday, the 6th day of July, 1931, the plaintiff caused to be filed in the office of the Supreme Court at Nelson a scheme providing for the disposition of the said bequest as in manner following :—

  1. The sum of £12,800, being part of the said bequest and accumulations, shall be held by the plaintiff in trust to expend the same in rendering fit for worship that portion of the new Cathedral in the City of Nelson now erected in accordance with plans and specifications prepared for such purpose.

  2. The balance of the said bequest shall be retained by the plaintiff to accumulate upon the original trust under the will of the above-named Frances Mary Marsden until such time as the erection of the said Cathedral is sufficiently advanced to permit the building of the spire.

The application to the Supreme Court to approve of the foregoing scheme is set down for hearing at Nelson on Tuesday, the 28th day of July, 1931.
