The Western Side of Portion of Adelaide Road, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 23rd day of March, 1931.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the fifth day of February, one thousand nine hundred and thirty-one, viz :—

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the western side of Adelaide Road fronting Lot 1, D.P. 736 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Adelaide Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Adelaide Road, fronting Lot 1, D.P. 736, being part section 1052, Town of Wellington R.D. As the said portion of street is more particularly delineated on the plan marked P.W.D. 80167, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“The Motueka Borough Council, being the local authority having control of the streets in the Borough of Motueka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the western side of Queen Victoria Street fronting Parts 2 of Section 197 marked ‘ A.B.’ on the plan ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Queen Victoria Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street, situated in the Nelson Land District, Borough of Motueka, known as Queen Victoria Street, fronting Section 2 of 197, Motueka Original District, Block VII, Motueka Survey District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 81331, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Revoking Order in Council licensing Alfred Roderick Alison of Auckland to use and occupy Part of the Foreshore and Land below Low-water Mark in Maiteatea Bay, Waiheke Island, Hauraki Gulf, for the Purpose of taking Sand.

ORDER IN COUNCIL.

At the Government House at Wellington, this 23rd day of March, 1931.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated the twenty-fourth day of October, one thousand nine hundred and twenty-three, and published in the New Zealand Gazette, No. 78, of the first day of the following month, Alfred Roderick Alison, of Auckland (who, with his executors, administrators, and assigns, is hereinafter called “the licensee”), was licensed to use and occupy a part of the foreshore and land below low-water mark in Maiteatea Bay, Waiheke Island, Hauraki Gulf, for the purpose of taking sand :

And whereas the licensee has applied to have the hereinbefore-recited Order in Council revoked, and it is desirable to revoke the same :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the twenty-fourth day of October, one thousand nine hundred and twenty-three, as from the thirty-first day of March, one thousand nine hundred and thirty-one.

Vesting a Reserve in the Lower Hutt Borough Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 23rd day of March, 1931.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart for recreation purposes :

And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Mayor, Councillors, and Burgesses of the Borough of Lower Hutt :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Mayor, Councillors, and Burgesses of the Borough of Lower Hutt, in trust, for recreation purposes.

SCHEDULE.

WELLINGTON LAND DISTRICT.—BOROUGH OF LOWER HUTT.

ALL that area in the Borough of Lower Hutt, Wellington Land District, containing by admeasurement 11·96 perches, more or less, being Section 2 of Block XLV of the Hutt Valley Settlement, and being portion of Section 18, Hutt Registration District, Block XIV, Belmont Survey District. As the same is delineated on plan numbered 134/59, deposited in the Wellington District Office, Department of Lands and Survey, and thereon bordered red.
