Provided that this condition shall not be so construed as to prohibit the use of any power-boat for camping purposes or for the purpose of travelling either to or from a rendezvous or generally or to prohibit shooting from a moored power-boat.
9. Any person committing a breach of any of these conditions is liable, on conviction, to a fine of £20.

SCHEDULE.

All that area in the Auckland Land District commencing at a point on the sea-coast due north of Trig. Station J1, in Block IV, Waihi South Survey District, proceeding thence due south to a point due east of Trig. Station Otane, Wainuku; thence by a right line running due west to Trig. Station Otane, Wainuku aforesaid, and passing through that station to its intersection with a line running between Trig. Station Puwhenua and Weraiti; thence by a right line to Trig. Station Weraiti; thence by a right line to Waranunau; thence north-westerly along the western boundary of Whakamarama No. 2 to Trig. Station Mimiohanga; thence generally north-westerly along the summit of the range and passing through Te Ariariparitupu, Pukupenga Ngatamahinerua, and on to its intersection with the confiscation boundary; thence south-westerly along the confiscation boundary to Te Aroha Trig. Station; thence by a right line to the mouth of the Waihi River; thence south-easterly along the sea-coast to the place of commencement, and including Mayor and Karewa Islands.

Open Season for Imported Game and Native Game, License Fees, &c., Waiapu Acclimatization District.

I N exercise of the powers vested in me by the Animals Protection and Game Act, 1921–22, I, Philip Aldborough de la Perrelle, Minister of Internal Affairs of the Dominion of New Zealand, do hereby declare the period from the 1st day of May to the 30th day of June, 1931 (both days inclusive), to be an open season in the Waiapu Acclimatization District described in the First Schedule hereto, except in the areas referred to in Condition No. 3, and in the Second Schedule hereto, for the taking or killing of the following imported game and native game—viz., cock pheasants, Californian quail, Australian quail, and grey duck—subject to the following conditions.


CONDITIONS.

  1. LICENSES to take or kill such imported game and native game within the said district will be issued to any person on payment of the sum of twenty shillings (20s.) each, and the Postmasters at Te Araroa, Ruatorea, Kahukura, Tokomaru Bay, Tolaga Bay, Waipiro Bay, Cape Runaway, and Hicks Bay are hereby authorized to sign and issue the said licenses.

  2. The number of such imported game and native game that may be taken or killed by any one person in any one day shall not exceed twenty-five head in all of cock pheasants and grey duck: Provided that not more than ten head of grey duck may be taken or killed by any one person in any one day.

  3. Nothing in any license to take or kill imported game and native game shall authorize the holder thereof to take or kill imported game or native game on lands actually and exclusively used by any registered acclimatization society for acclimatization purposes, or on any sanctuary or public domain.

  4. No person shall kill or destroy any such imported game or native game, or shoot at or attempt to shoot at any such imported game or native game, with any automatic or auto-loading gun, unless it is converted into a gun capable of carrying two cartridges only, or with any rifle or pea-rifle, swivel-gun, punt-gun, or pump-gun, or shall use any gun other than a shoulder-gun; and no gun shall be used for the purpose aforesaid the bore of which is larger than the size known as No. 12 at the muzzle, nor shall any gun be used which exceeds 10 lb. in weight, and no cartridge shall be used the length of which exceeds 2¾ in.

  5. Shooting may begin not earlier than one hour before sunrise and must cease not later than one hour after sunset.

  6. No live birds of any species shall be used as decoys, nor shall more than twenty-five artificial decoys be used at any one time (whether by one or several persons) on any particular water within an area of less than 100 yards square.

  7. No person shall use or cause to be used any aeroplane in connection with the taking or killing of imported game or native game:

Provided that this condition shall not be so construed as to prohibit the use of any aeroplane for the purpose of travelling either to or from a rendezvous.

  1. No person shall use or cause to be used on any lake, pond, lagoon, mere, estuary, or other dead water any power-boat for the purpose of taking or killing, whether by himself or by some other person or persons at his direction, by driving, chasing, frightening, or stalking any imported game or native game. For the purpose of this condition, power-boat means and includes any launch, boat, canoe, or other similar craft propelled either wholly or partly by mechanical power:

Provided that this condition shall not be so construed as to prohibit the use of any power-boat for camping purposes or for the purpose of travelling either to or from a rendezvous or generally, or to prohibit shooting from a moored power-boat.

FIRST SCHEDULE.

All that area in the Gisborne Land District bounded by a line commencing at the south-western corner of Whangaparaoa No. 1 Block, and proceeding thence northerly, easterly, and southerly along the sea-coast to Pakarae No. 1 Block; along the northern boundary of that block to the Pakarae River, and up that river to and along the north-western boundary of Section 2, Block XIII, Uawa Survey District; along the northern boundary of Waimata North No. 1, the north-eastern boundaries of S.G. Run 58, Waimata North 1A, 2, and along the northern boundary of S.G. Run 58 aforesaid, to a public road; along that road running north through S.G. Run 43 to the south-eastern boundary of Lot 1 of S.G. Run 43A; along the south-eastern and north-eastern boundaries of said Lot 1; along the south-eastern, northern, and north-western boundaries of S.G. Run 42 to Waiapu Inland Road; along that road to Waingaromia 1c Block; along the north-eastern boundary of that block to the Waingaromia River; up that river to and along the north-eastern boundary of Waipaoa 3B, the north-eastern boundary of Waipaoa No. 2, the eastern boundaries of Sections 1, Block IX, 2, Block V, and 1, Block VI, Tutamoe Survey District; westerly along the southern boundary Huiarua No. 3 Block, and northerly along the western boundary of that block to its intersection with a right line between Arowhana and Kapua Trig. Stations; thence north-easterly along that line, a right line to Whanakaoa Trig. Station, and a right line to Pakira Trig. Station; along the south-western and western boundaries of Waikura No. 2, the western boundary of Whangaparaoa No. 3A Block, and the southern boundary of Whangaparaoa No. 1 Block, to the point of commencement.

SECOND SCHEDULE.

Areas in addition to those referred to in Condition No. 3 excepted from the open season wherein imported game and native game shall not be taken or killed:—

(1) The whole of the Te Araroa Township Sections except Section 22.

(2) Mr. H. K. Hovell’s farm and the Whetumatarau Hill.
