Education Reserves in North Auckland Land District for Lease by Public Auction.

North Auckland District Lands and Survey Office,
Auckland, 16th February, 1931.

NOTICE is hereby given that the undermentioned education reserves will be offered for lease by public auction at the North Auckland District Lands and Survey Office, Auckland, at 11 o’clock a.m. on Friday, 10th April, 1931, under the provisions of the Education Reserves Act, 1928, and the Public Bodies’ Leases Act, 1908.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

Otamatea County.—Mareretu Parish.

ALLOTMENTS 164 and 167; Area, 243 acres 1 rood 30 perches. Upset annual rental, £7 10s.

Situated at Mareretu on the old North Road. Nearest school at Taipuha, about three miles distant. Rather poor rough country, mostly covered with tea-tree. About 50 acres have been burnt and sown in grass, but are reverting to scrub and fern. Soil is clay on clay formation. Well watered by streams; no buildings. Altitude from 250 ft. to 600 ft. above sea-level.

Whangarei County.—Whangarei Survey District.

Section 4, Block IV: Area, 48 acres 0 roods 32 perches, Upset annual rental, £8 10s.

Situated at the mouth of Ngunguru River. Access is from Kiripaka, which is about eight miles distant by cart-road; thence by river a quarter of a mile to section. About 3 acres swampy, 3 acres broken, and balance undulating to hilly. About 5 acres bush; balance in tea-tree. Good black soil on swamp portion, and fair black soil on half the remainder, resting on clay subsoil. Watered by two small creeks.

Whangarei County.—Suburbs of Grahamtown.

Section 18: Area, 13 acres 2 roods 28 perches. Upset annual rental, £3 10s.

Situated at Onerahi, four miles and a half from Whangarei. Access by metalled road from Whangarei, with exception of last three-quarters of a mile, which is unformed. Undulating land in tea-tree and gorse; clay soil. Poorly watered.

Whangarei County.—Town of Grahamtown.

Section 257: Area, 1 acre. Upset annual rent. £2 10s.

Situated on main road at Onerahi, four miles from Whangarei by good metalled road. Section is all level in tea-tree, with a little gorse. A hundred yards from school, half a mile from post-office and store. Soil is chocolate-coloured clay on a clay formation. Town water-supply passes the property. Elevation, 150 ft. above sea-level.

Eden County.—Village of Panmure.—Mount Wellington Road District.

Lot 1 of Allotment 43, of Section 2: Area, 1 rood 10 perches. Upset annual rent, £6.

Lot 4 of Allotment 43 of Section 2: Area, 1 rood. Upset annual rent, £7 10s.

Lot 8 of Allotment 43 of Section 2: Area, 1 rood. Upset annual rent, £7.

Lot 9 of Allotment 43 of Section 2: Area, 1 rood. Upset annual rent, £7.

Lot 10 of Allotment 43 of Section 2: Area, 1 rood. Upset annual rent, £7.

Lot 11 of Allotment 43 of Section 2: Area, 2 roods 14·3 perches. Upset annual rent, £12 10s.

Sections are situated at Panmure within easy distance of new railway-station, and just off the Panmure–Howick concrete road. Sections all elevated, and practically level, overlooking the Panmure basin. Five feet of water along the bank at high tide. Ten chains from Panmure Post-office, two miles and three-quarters from Ellerslie. Good bus service. Soil heavy black loam on sandstone formation.

ABSTRACT OF TERMS AND CONDITIONS OF LEASE.

  1. Six months’ rent at the rate offered, loading for improvements, and £2 2s. (lease fee) must be deposited on acceptance of bid.

  2. Term of lease: Twenty-one years, with perpetual right of renewal for further similar terms at rentals based on fresh valuations under the provisions of the Public Bodies’ Leases Act, 1908.

  3. Rent payable half-yearly in advance.

  4. Lessee to maintain in good substantial repair all buildings, drains and fences; to keep clear all creeks, drains, ditches, and watercourses; to trim all live hedges; and yield up all improvements in good order and condition at the expiration of his lease.

  5. Lessee not to transfer, sublet, or subdivide without the consent of the Land Board.

  6. Lessee not to use or remove any gravel without the consent of the Land Board.

  7. Lessee not to carry on any noxious, noisome, or offensive trade upon the land.

  8. No liability is accepted on the part of the Crown or of the Land Board to pay to the lessee any compensation for improvements, but if the lease is not renewed upon expiration, or if it is sooner determined, the new lease offered for disposal by public competition will be subject to payment by the incoming tenant of an amount equal to the value of buildings and improvements effected by the original lessee; and the amount so paid by the incoming tenant shall be paid to the original lessee without any deduction except for rent or other payments in arrear.

  9. Lease liable to forfeiture if conditions are violated.

  10. Lessee to keep buildings insured.

  11. Interest at the rate of 10 per cent. per annum to be paid on rent in arrear.

Timber in the Marlborough Land District for Sale by Public Auction.

NOTICE is hereby given that the right to cut and remove the timber on the undermentioned land will be offered for sale by public auction at the District Lands and Survey Office, Blenheim, at 11.30 o’clock a.m. on Friday, the twenty-seventh March, 1931, under the provisions of the Land Act, 1924, and the timber regulations made thereunder.

SCHEDULE.

PART of Section 3, Block I, Onamalutu Survey District: Area, 176 acres. Situated about eight miles from Canvastown and the main Blenheim–Nelson highway. The road from Canvastown is in very fair order. Timber is of good quality, particularly the matai. Estimated quantity:—

Time for removal of timber: Two years from date of sale.

Terms of Payment.

£430 of the purchase-price, together with £1 1s. license fee, to be paid on the fall of the hammer, and the balance by two “on demand” promissory notes endorsed by two approved sureties, such bills to be completed and lodged with the Commissioner of Crown Lands within fourteen days after the date of sale. The bills will be presented for payment twelve months and twenty-four months respectively after the date of sale.

Conditions of Sale.

  1. The right to cut and remove the timber will be sold in accordance with the provisions of the Land Act, 1924, the regulations in force thereunder, and these conditions, and such additional conditions as the Commissioner of Crown Lands considers necessary in the interests of the Crown or of the public.

  2. Intending purchasers are expected to visit the locality and to satisfy themselves in every particular on all matters relative to the sale.

  3. For the purposes of this sale the foregoing description of the timber shall be taken as sufficiently accurate as to quantities, qualities, and kinds, and no contract for the purchase of the timber shall be voidable, nor shall the purchaser be entitled to any abatement in price, by reason of any error or misdescription herein or in any advertisement having reference to this sale; nor shall any extra sum be claimed by the Crown if the quantity of timber is found to be in excess of that stated herein.

  4. The attention of all intending purchasers is drawn to the fact that the local controlling body may require the purchaser to pay any claims or charges which may be made by that body for the maintenance of the road over which the timber may be transported, and before a sawmill license is issued to the purchaser, a letter indicating that satisfactory arrangements have been made in this connection must be produced to the undersigned.
