Kerr’s Lane, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 30th day of January, 1931.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the twenty-second day of December, one thousand nine hundred and thirty, viz.:

“The Christchurch City Council, having control of Kerr’s Lane in the City of Christchurch, hereby by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the said street”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting either side of Kerr’s Lane (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said street.

SCHEDULE.

ALL that street situated in the Canterbury Land District, City of Christchurch, known as Kerr’s Lane, fronting R.S. 136. As the said street is more particularly delineated on the plan marked P.W.D. 80895, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Grass Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the thirteenth day of November, one thousand nine hundred and thirty, viz.:

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the northern side of Grass Street fronting that part of Lot 35, D.P. 475, comprised in Certificate of Title, Vol. 124, folio 245, Wellington Registry”; such portion of street being described in the Schedule hereto.

SCHEDULE.

THE northern side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Grass Street, fronting part of Lot 35, D.P. 475, being part Section 1, Evans Bay R.D. As the same is more particularly delineated on the plan marked P.W.D. 80822, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the north-western side of Beaumont Road, in the said City of Dunedin, where such portion of street abuts on Lot 1, L.T.P. 601, being part Block X, Belleknowes Estate, as the said portion of street is more particularly shown on the plan annexed hereto and is thereon coloured brown and edged with red to its centre-line”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Beaumont Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
