ALL that area in the North Auckland Land District, Mangonui County, situate in Block V, Opoe Survey District, containing by admeasurement 50 acres 1 rood 37 perches, more or less, being portion Opoe Kauri-gum Reserve Extension No. 2, as described in New Zealand Gazette, 1899, No. 60, page 1303, bounded as follows: Commencing at a point being the north-western corner of Section 27, Block V, Opoe Survey District; thence on the west and north by portion Opoe Kauri-gum Reserve Extension No. 2, as described in New Zealand Gazette, 1899, No. 60, page 1303, bearing 3° 44′ distance 2189·4 links, bearing 93° 26′ distance 1446·5 links, to a public road; thence on the east generally by the said public road bearing 132° 49′ 30″ distance 589·2 links, bearing 148° 26′ distance 840·4 links, bearing 147° 10′ distance 324·7 links, bearing 174° 32′ distance 260·4 links, bearing 137° 27′ 30″ distance 238·5 links, bearing 219° 12′ distance 552·7 links, to Section 27 afore-mentioned; thence on the south by the said Section 27, bearing 273° 34′ distance 2476·3 links, to the point of commencement. As the same is more particularly delineated on the plan marked L. and S. 26/25089, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. Withdrawing Lands from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 30th day of January, 1931.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council gazetted, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified, the land to which the Order relates shall become subject to the provisions of the Land Act, 1924:

And whereas the Land Board of the North Auckland Land District has duly passed a resolution recommending that portion of the Opoe Kauri-gum Reserve Extension No. 2 and portion of the Opoe Kauri-gum Reserve Extension, as described in the Schedule hereto, be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation:

Now, therefore, I, Charles, Baron Bledisloe, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that portion of the Opoe Kauri-gum Reserve Extension No. 2 and portion of the Opoe Kauri-gum Reserve Extension, as described in the Schedule hereto, shall, from the seventh day of January, one thousand nine hundred and thirty-one, cease to be subject to the Kauri-gum Industry Act, 1908.


SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALL that area in the North Auckland Land District, Mangonui County, situate in Block V, Opoe Survey District, containing by admeasurement 3 roods 39 perches, more or less, being portion of the Opoe Kauri-gum Reserve Extension No. 2, as described in New Zealand Gazette, 1899, No. 60, page 1303, bounded as follows: Commencing at a point on a public road, being the south-western corner of Section 6, Block V, Opoe Survey District (a public-school site by notice published in New Zealand Gazette, 1921, No. 80, page 2255); thence on the south by the said public road, bearing 232° 03′ distance 287·5 links; on the west and north by portion of the Opoe Kauri-gum Reserve Extension No. 2, as described in New Zealand Gazette, 1899, No. 60, page 1303, bearing 8° 47′ distance 603·7 links, bearing 97° 21′ distance 199·3 links; and on the east by Section 6 aforementioned, bearing 189° 06′ distance 399·4 links, to the point of commencement. As the same is more particularly delineated on the plan marked L. and S. 2/571, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. Also all that area in the North Auckland Land District, Mangonui County, situate in Block V, Opoe Survey District, containing by admeasurement 2 acres 0 roods 13 perches, more or less, being portion of the Opoe Kauri-gum Reserve Extension, as described in New Zealand Gazette, 1899, No. 32, page 757, bounded as follows: Commencing at a point on a public road being Peg V on Survey Office plan 26071 (North Auckland); thence on the north-east and south-east by the said public road, bearing 121° 00′ distance 300·6 links, bearing 198° 54′ 30″ distance 416·3 links, bearing 128° 38′ distance 200·0 links; and on the south-west and north-west by portion of the Opoe Kauri-gum Reserve Extension, as described in New Zealand Gazette, 1899, No. 32, page 757, bearing 301° 00′ distance 325·6 links, bearing 31° 00′ distance 597·1 links, to the point of commencement. As the same is more particularly delineated on the plan marked L. and S. 2/571A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. The South-western Side of Portion of City Road and the North-eastern Side of Portion of Charlotte Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 30th day of January, 1931.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the ninth day of April, one thousand nine hundred and thirty, viz.:

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets in the said City of Dunedin, viz.:

“ (a) Portion of the south-western side of City Road, where it abuts on Lot 34, Township of Kaikorai;

and

“ (b) Portion of the north-eastern side of Charlotte Street, where it abuts on Lot 34, Township of Kaikorai;

as the said two portions of streets are more particularly shown on the plan annexed hereto and are thereon coloured red to their respective centre-lines ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of City Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street, or fronting the north-eastern side of the portion of Charlotte Street (described in the Schedule hereto) within a distance of twenty-five feet from the centre-line of the said portion of street.


SCHEDULE.

THE south-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as City Road, fronting Lot 34, Township of Kaikorai.

Also the north-eastern side of all that portion of street in the said land district and city, known as Charlotte Street, fronting Lot 34, Township of Kaikorai.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 80758, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
