Extending Prohibition of Alienation of certain Native Lands other than Alienation in favour of the Crown.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 30th day of January, 1931.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section and by section one hundred and eleven of the Native Land Amendment Act, 1913 (as amended by section eight of the Native Land Amendment and Native Land Claims Adjustment Act, 1916), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby extend for a further period of eighteen months the Order in Council dated the nineteenth day of August, one thousand nine hundred and twenty-nine, and gazetted the twenty-second day of August, one thousand nine hundred and twenty-nine, prohibiting all alienation of the Native land specified in the Schedule hereto, other than alienation in favour of the Crown.

IN pursuance and exercise of the powers conferred upon him by section nine of the Explosive and Dangerous Goods Amendment Act, 1920, and of all other powers enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint the Inangahua County Council, the Awatere County Council, and the Tahunanui Town Board to be licensing authorities for the purposes of the said Act within their respective districts.

License authorizing Wilson’s (N.Z.) Portland Cement, Ltd., to erect Electric Lines in the Whangarei County and Hikurangi Town District.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 30th day of January, 1931.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize Wilson’s (N.Z.) Portland Cement, Ltd. (hereinafter referred to as “the licensee”) to lay, construct, put up, place, and use electric lines along the route hereinafter defined; the said route being indicated by double yellow lines on the plan marked P.W.D. 79910, deposited in the office of the Minister of Public Works at Wellington.

CONDITIONS.

  1. ROUTE OF LINES.

COMMENCING at the licensee’s generator-house at Waro, and proceeding thence generally in a westerly direction to the shaft of the Hikurangi Coal Company’s mine, being a distance of approximately sixty chains.

  1. PURPOSES OF LINES.

The said lines may be used for lighting, power, and heating purposes.

  1. LICENSE TO BE SUBJECT TO REGULATIONS.

The license hereby conferred is subject to compliance by the licensee with the regulations made under section 2 of the Public Works Amendment Act, 1911, on the 11th day of July, 1927, and published in the Gazette on the 12th day of the same month (hereinafter called “the said regulations”), and with all regulations hereafter made in amendment thereof or in substitution therefor.

  1. SYSTEM OF SUPPLY.

The system of supply shall be the system described in paragraphs (a) and (e) of clause 5 of the said regulations.

  1. GENERATING VOLTAGE.

The generating voltage shall be approximately 400 volts between the terminals and transformed to 2,200 volts for transmission.

  1. DURATION OF LICENSE.

This license shall, unless sooner determined, whether by surrender by the licensee or by revocation under the provisions contained in the said regulations or in any amending or substituted regulations, continue in force for a period of twenty-one years from the date hereof.

  1. EFFECT OF DETERMINATION OF LICENSE.

The determination of this license, whether by expiration of time, by surrender, or by revocation as aforesaid shall not relieve the licensee from any liability theretofore incurred under this license.

  1. RAILWAY AND TELEGRAPH LINES.

The licensee shall, from time to time, rectify to the satisfaction of the Minister of Railways and Minister of Telegraphs, respectively, any interference or disturbance caused by the erection or operation of the licensee’s system that affects the satisfactory working of any telegraph-line which is under the control of or in use by the Railway Department and the Post and Telegraph Department, respectively, and which was erected before the erection of the lines hereby licensed.

  1. POWER TO PURCHASE LICENSEE’S INSTALLATION.

An Electric-power Board duly constituted in terms of the Electric-power Boards Act, 1925, or any Act passed in amendment thereof or in substitution therefor, shall, if its district includes the area within which are erected the lines authorized by this license, have the right at any time during the currency of this license to purchase and take over the licensee’s installation at a valuation to be agreed on between the Board and the licensee, and failing such agreement, at a valuation to be fixed by a single arbitrator to be appointed pursuant to the provisions of the Arbitration Act, 1908, and thereupon the Governor-General may by Order in Council revoke this license.
