Public Works Act Exemptions




and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Dunedin City Council on the
eighteenth day of December, one thousand nine hundred
and twenty-nine, viz.:—
“ That the Dunedin City Council, being the local authority
having control of the streets in the City of Dunedin, by
resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to that portion of the south-eastern side of
Warden Street in the said City of Dunedin, where such
portion of street abuts on Allotment 10, Block I, Township
of Opoho, as the said portion of street is more particularly
shown on the plan annexed hereto, and is thereon coloured
blue to the centre-line thereof ” ;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
eastern side of the portion of Warden Street (described in the
Schedule hereto) within a distance of thirty-three feet from
the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street situated
in the Otago Land District, City of Dunedin, known as
Warden Street, fronting Allotment 10, Block I, Township
of Opoho. As the said portion of street is more particularly
delineated on the plan marked P.W.D. 77496, deposited in
the office of the Minister of Public Works at Wellington,
and thereon coloured blue.

Tawariki Road and Moira Avenue, in the City of Auckland,
exempted from the Provisions of Section 128 of the Public
Works Act, 1928, subject to a Condition as to the Building-
line.

At the Government House at Wellington, this 3rd day of
February, 1930.

His Excellency The Governor-General in Council.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution,
passed by the Auckland City Council on the fifth day of
December, one thousand nine hundred and twenty-nine,
viz.:—
“ The Auckland City Council, being the local authority
having control of the streets in the City of Auckland, by
resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to that street known as “ Tawariki Road,”
adjoining Lots 59 to 93 and 111 to 126 of part Allotments
27 and 28, Section 8, Suburbs of Auckland, nor to that
street known as “ Moira Avenue,” adjoining Lots 93 to 96,
140 to 152, 112, and 127 to 139 of part Allotments 27 and
28, Section 8, Suburbs of Auckland ” ;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting Tawariki
Road (firstly described in the Schedule hereto) or Moira
Avenue (secondly described in the Schedule hereto), within a
distance of forty-two feet from the centre-lines of the said
streets.

SCHEDULE.

THAT street known as Tawariki Road, in the North Auckland
Land District, City of Auckland, adjoining Lots 59 to 93
and 111 to 126 of a subdivision of part Allotments 27 and 28,
Section 8, Suburbs of Auckland.
Also that street known as Moira Avenue in the said land
district and city adjoining Lots 93 to 96, 140 to 152, 112, and
127 to 139 of a subdivision of part Allotments 27 and 28,
Section 8, Suburbs of Auckland.
As the same are more particularly delineated on the plan
marked P.W.D. 75492, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

of Wellington, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

fourteenth day of November, one thousand nine hundred and
twenty-nine, viz.:—
“ The Wellington City Council, being the local authority
having control of the streets in the City of Wellington, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to that part of the eastern side of Moxham Avenue
fronting Lots 50 and 51, D.P. 168 ”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the eastern
side of the portion of Moxham Avenue (described in the
Schedule hereto) within a distance of thirty-three feet from
the centre-line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street situated in the
Wellington Land District, City of Wellington, known as
Moxham Avenue, fronting Lots 50 and 51, D.P. 168, being
part Section 4, Evans Bay District, Block VII, Port Nicholson
Survey District. As the said portion of street is more
particularly delineated on the plan marked P.W.D. 77478,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

in the said City of Dunedin where such portion of street
abuts on part Allotment 13, Block VIII, Township of
South Dunedin, as the said portion of street is more
particularly shown on the plan annexed hereto, and is
thereon coloured brown and edged with red to its centre-
line ”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
eastern side of the portion of Oxford Street (described in the
Schedule hereto) within a distance of thirty-three feet from
the centre-line of the said portion of street.
