The Eastern Side generally of Portion of Wakapuaka Road, in the Waimea County, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 12th day of December, 1930.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the second day of October, one thousand nine hundred and thirty, viz.:

“That the Waimea County Council, being the local authority having control of the roads in the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of the Wakapuaka Main Highway fronting Section 14, Block IX, Wakapuaka Survey District, with the exception of a distance of 142·85 links, being the southern portion of the said Section 14, and owned by D. O. Ollson”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side generally of the portion of Wakapuaka Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE eastern side generally of all that portion of road, situated in the Nelson Land District, County of Waimea, known as Wakapuaka Road, fronting part Section 14, Square 23, Block IX, Wakapuaka Survey District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 80526, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Order in Council consenting to the Raising of a Loan of £1,250 by the Waipara County Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 12th day of December, 1930.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Waipara County Council (hereinafter called “the said local authority”) proposes, pursuant to section one hundred and thirty-five of the Public Works Act, 1928, to borrow the sum of one thousand two hundred and fifty pounds for the purpose of meeting the county’s share of the cost of constructing a new bridge over the Hurunui River and approaches thereto, on the Christchurch–Blenheim via Parnassus Main Highway, by a loan to be known as “Hurunui River Bridge Loan, 1930”:

And whereas the Minister of Finance has given his precedent consent as required by section one hundred and fourteen of the Local Bodies’ Loans Act, 1926, to the borrowing by the said local authority of the said sum of one thousand two hundred and fifty pounds at a rate or rates of interest being such as shall not produce to the lenders a rate exceeding the rate of five pounds fifteen shillings per centum per annum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the Local Government Loans Board Act, 1926, and by section one hundred and fourteen of the Local Bodies’ Loans Act, 1926, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan up to the amount of one thousand two hundred and fifty pounds for a term of thirty years, at such rate or rates of interest as shall not produce to the lenders a rate exceeding the rate of five pounds fifteen shillings per centum per annum, subject to the condition that the said local authority shall, before borrowing the said sum or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies’ Loans Act, 1926, and shall thereafter make to such sinking fund payments at intervals of not more than one year at a rate or rates which shall be not less than the rate of one pound ten shillings per centum, such payments to be made in respect of every part of the said sum for the time being so borrowed and not repaid, and the first payment to be made not later than one year after the first day from which interest to the lender is computed on any moneys so borrowed, and subject to the further condition that no portion of interest or sinking fund shall be paid out of loan-moneys.

Revoking Order in Council licensing Alfred Roderick Alison to use and occupy Part of the Foreshore at Church Bay, Waiheke Island, as a Site for a Wharf.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated the twenty-ninth day of June, one thousand nine hundred and twenty-five, and published in the New Zealand Gazette, No. 50, of the second day of the following month, Alfred Roderick Alison (who, with his executors, administrators, and assigns is hereinafter called “the licensee”) was licensed to use and occupy part of the foreshore below low-water mark at Church Bay, Waiheke Island, as a site for a wharf:

And whereas the licensee has applied to have the hereinbefore-recited license revoked, and it is desirable to revoke the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the twenty-ninth day of June, one thousand nine hundred and twenty-five, as from the date hereof.

IN pursuance and exercise of the powers and authorities conferred by section forty of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that from and after the thirty-first day of December, one thousand nine hundred and thirty, the public domains described in the Schedules hereto shall be united to form one public domain, to be known as the Christchurch City and Suburban Domain.

FIRST SCHEDULE.

BECKENHAM DOMAIN.

ALL that area in the Canterbury Land District, containing by admeasurement 11 acres 0 roods 32·2 perches, more or less, being Lots 165 and 166 of deposit plan 1983, and parts Lots 2, 3, 4, 5, and 6, of deposit plan 2495, situated in the City of Christchurch, and bounded as follows: Towards the north by Lots 140–146 of deposit plan 1696, and Lots 1, 2, 3, and 10 of deposit plan 9411, 1173·7 links; towards the east by Eastern Terrace, along the left bank of the Heathcote River; towards the south by part Lot 10 of deposit plan 2623, 122·5 links; towards the west by other part Lot 6 of deposit plan 2495 above mentioned, 106·6 links; again towards the south by other parts Lots 5 and 6 of deposit plan 2495, 186·4 links;
