SCHEDULE.

ALL that area in the Otago Land District containing by admeasurement 3 roods, more or less, being Sections 1, 2, and 21, Block IV, Town of Balclutha, and bounded as follows: Towards the north-east by Sections 20 and 18, 300 links; towards the south-east by Section 3, 250 links; towards the south-west by Stamford Street, 300 links; and towards the north-west by Pakefield Street, 250 links: be all the aforesaid linkages more or less. As the same is more particularly shown on the plan marked L. and S. 9/2439, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Cancelling a Condition as to setting back the Building-line of Portion of Tamar Street, in the City of Wellington, imposed by Order in Council under Section 117 of the Public Works, Act, 1905.

At the Government House at Wellington, this 8th day of September, 1930.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the seventh day of January, one thousand nine hundred and seven, and published in the New Zealand Gazette, No. 2, of the tenth day of January, one thousand nine hundred and seven, exempting Tamar Street, in the City of Wellington, from the provisions of section one hundred and seventeen of the Public Works Act, 1905, subject to a condition as to the building-line, by cancelling the condition as to the building-line imposed by the said Order in Council in so far as it affects part Section 5, Town District, Block X, Port Nicholson Survey District; as the same is more particularly delineated on the plan marked P.W.D. 77707, deposited in the office of the Minister of Public Works at Wellington, and thereon edged green.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the development of water-power, Mangahao Scheme.


SCHEDULE.

APPROXIMATE area of the piece of land permitted to be taken:
3 acres 0 rood 14·3 perches.
Being portion of Section 37.
