HOLDER OF TEMPORARY PERMIT OR PASSENGER BY ANY VESSEL WHO
COMMENTS AN OFFENCE TO BE TREATED AS A PROHIBITED IMMI-
GRANT.
- Every person to whom a temporary permit has been granted
who commits an offence under paragraphs (b) or (c) of subclause (1)
of clause 9 hereof, and every person who lands in Samoa under the pro-
visions of subclause (d) of clause 12 hereof, but who fails to leave Samoa
as provided in the said subclause (d) of clause 12 hereof, shall be deemed
to be a prohibited immigrant, and the provisions of clauses 4, 5, and
8 hereof shall apply, mutatis mutandis, to such person and to the ship
in which he travelled to Samoa, and the owner, charterer, and master
thereof.
EXEMPTION FROM PROVISIONS OF ORDER.

The foregoing provisions of this Order shall not apply to—
(a) His Majesty’s land and sea forces.
(b) The officers and crew of any ship of war of any Government.
(c) Any person, being one of the officers or crew of any mercantile
vessel, provided—
(i) That he is not discharged in Samoa:
(ii) That he is on board the vessel when she is cleared
outwards and leaves Samoa with her:
(iii) That the Collector of Customs may, by notice
under his hand delivered to the master of any such vessel,
prohibit the landing in Samoa of its crew unless and until
the master shall have executed a bond with two sureties,
to be approved by the Collector, in such sum as the Collector
shall determine, conditioned for the due departure of the
said crew when the vessel resumes its voyage from Samoa.
(d) Any person arriving in Samoa as a passenger in the course of
his journey by any vessel to any place beyond Samoa if he
leaves Samoa with that vessel on her first departure from
the Territory.
(e) Any person duly accredited to the Administration of Samoa
by or under the authority of the Imperial or any other
Government. -
(1) Notwithstanding the last preceding clause of this Order,
if an officer of Customs or of Police has reason to believe or suspect
that any person arriving in Samoa from beyond the seas is a person
whose landing in Samoa is prohibited by this Order, or whose intention
to land in Samoa should be communicated to the Administrator for the
purposes of this Order, such officer may, by order signed by him,
temporarily prohibit that person from landing in Samoa.
(2) Every such order shall, unless sooner revoked, expire in forty-
eight hours after the day on which it was signed.
(3) Every person who, with knowledge that such an order has been
made against him, lands in Samoa while the order remains in force,
shall be liable to a fine of £100 or to imprisonment for a period not
exceeding six months.
MISCELLANEOUS PROVISIONS.
- (1) For the purpose of ensuring compliance with the fore-
going provisions of this Order an officer of Customs and of Police shall
board every vessel arriving from places beyond Samoa forthwith after
its arrival at any port or harbour in Samoa.
(2) The master of the vessel shall forthwith deliver to the officer
of Customs the passenger-list and crew-list, or a true copy thereof,
and shall truly answer any questions relating to the passengers and
crew which may be put to him by the officer of Customs or the officer
of Police for the purposes of this Order,
