FEATHERSTON COUNTY COUNCIL.
RESOLUTION STRIKING SPECIAL RATE.
IN pursuance and exercise of the powers vested in it in that behalf by the Local Bodies’ Loans Act, 1926, and the Local Government Loans Board Act, 1926, and all other powers (if any) thereunto enabling, the Featherston County Council hereby resolves as follows :—
That, for the purpose of providing for the payment of interest and principal on the Featherston County Main Highway Loan No. 2 of five thousand pounds (£5,000), 1928, authorized to be raised by the Featherston County Council under the above-mentioned Acts for the purpose of effecting improvements of main highways in the county, the said Council hereby makes and levies a special rate of one-twelfth (1/12th) of one penny in the pound sterling on the rateable value (on the basis of the unimproved value) of all rateable property in the whole of the County of Featherston, and that such special rate shall be an annual-recurring rate during the currency of such loan, and be payable yearly on the 1st day of April in each and every year during the currency of such loan, being a period of fifteen (15) years, or until the loan is fully paid off.

RYAL BUSH ANGLICAN CHURCH.
In the Supreme Court of New Zealand,
Otago and Southland District.
In the matter of the Religious, Charitable, and Educational Trusts Act, 1908, and its amendments, and in the matter of the estate of CORNELIUS HARRY BUTLER, late of Ryal Bush, Farmer (deceased), and in the matter of a Declaration of Trust dated 8th July, 1907, made by the said Cornelius Harry Butler and others, between EDMUND RICHARDSON WILSON, of Invercargill, Architect, and others, the trustees of the will of the said Cornelius Harry Butler (deceased), plaintiffs, and His Majesty’s Attorney-General for New Zealand, CECIL BROCK TAPLEY, of Invercargill, Shipping Agent, and others, the trustees of the above-mentioned Declaration of Trust, EDWARD WALLACE BUTLER, of Seaward Downs, Farmer, one of the next-of-kin of the said Cornelius Harry Butler (deceased) and THE DUNEDIN DIOCESAN TRUST BOARD, defendants.
WHEREAS the above-named Cornelius Harry Butler (who died on the 24th June, 1917) by his will dated 17th October, 1914 (inter alia), gave the residue of his real and personal property to his trustees for the purpose of the erection of a church upon a site mentioned in the above Declaration of Trust and in accordance with a plan provided by him, and directed that on completion of the said church the same would be vested in the Dunedin Diocesan Trust Board : And whereas the said C. H. Butler during his lifetime collected certain funds for the same object, which are now in the hands of the plaintiff trustees : And whereas the Dunedin Diocesan Trust Board holds a more commodious site on which is situated the present church, which is very old and dilapidated, and practically beyond repair : And whereas a church built in accordance with the plan mentioned in the will of the said C. H. Butler would be far beyond the present or future requirements of the district : And whereas it is inexpedient to carry out the trusts for the building of a church in accordance with the said plan on the site mentioned in the said will, and it is desirable that the property and funds above referred to should be disposed of for the charitable purpose of a similar nature hereinafter set forth :
Now this is to notify all whomsoever it may concern that on the 21st day of January, 1930, the trustees of the will of the said C. H. Butler (deceased) caused to be filed in the office of the Supreme Court at Invercargill a scheme as submitted to His Majesty’s Attorney-General for New Zealand providing for the disposal of the said property and funds in manner following :—

That the funds now or hereafter held by the plaintiff trustees for the erection of a church as hereinbefore mentioned be applied by them in or towards the cost of erecting, equipping, furnishing, maintaining, and repairing a church on the site at Ryal Bush now held by the Dunedin Diocesan Trust Board, instead of on the site referred to in the Declaration of Trust of the 8th day of July, 1907, and in the will of the said C. H. Butler, such church to be built in accordance with some other plan that may be approved of by the said trustees and by the Bishop of the Diocese, but which in general design shall be on similar lines as near as may be to the plan referred to by the said C. H. Butler in his said will.

That part of the said church comprising the nave and porch to be built out of the funds now available and in the hands of the plaintiff trustees, and that the remainder of the said church be built when the remaining funds become available.

That the trustees acting under the said Declaration of Trust sell the site held by them under the said Declaration of Trust and apply the proceeds of such sale in or towards the erection of such church as aforesaid.

That all reasonable costs and expenses of and incidental to the preparation and disposal of the foregoing scheme be paid out of the said trust funds.
