Imposing Restrictions on the Taking of Mussels in Whangarei
Harbour.

ORDER IN COUNCIL.
At the Government House at Wellington, this 26th day of
April, 1930.
Present:
His Excellency The Governor-General in Council.
WHEREAS it is provided by section five of the Fisheries
Act, 1908, that the Governor-General may from time
to time, by Order in Council gazetted, make regulations, which
shall have force and effect either throughout New Zealand or
only in such waters or places as are specified in the regulations
for, inter alia, imposing conditions and restrictions on the
taking of fish, and prescribing in any part or parts of New
Zealand a close season over any term not exceeding three
years :
And whereas it is expedient to make certain regulations
imposing conditions and restrictions on the taking of mussels
in those waters of Whangarei Harbour hereinafter defined :
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand in pursuance and exercise of the
hereinbefore-recited power and authority, and of all other
powers and authorities enabling him in that behalf, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby make the following
regulations.
REGULATIONS.
(1) No person shall take or have in possession, for purposes of
sale, mussels from the waters more particularly described in
the Schedule hereto.
(2) It shall be lawful for any person to take mussels from the
said area for home consumption only, but no such person
shall take more than fifty mussels for such purpose in any
one day.
(3) Any person committing a breach of these regulations
shall be liable to a fine of £20.
SCHEDULE.
All that area of sea-bed bounded by a line commencing at the
southern extremity of Busby Head and proceeding due west
to the Marsden Point Beach; thence north-easterly and
north-westerly along the line of ordinary high-water mark to
the Marsden Point Wharf ; thence by a direct line across the
Whangarei Harbour to the southern extremity of Lort Point,
Reotahi ; thence generally easterly and southerly along the
ordinary high-water mark of the Whangarei Harbour to the
starting-point at Busby Head. As the said area is more
particularly shown and delineated on plan marked M.D. 6783,
deposited in the office of the Marine Department at Wellington,
and thereon coloured blue.

The Southern Side of Portion of Gill Street, in the Borough of
New Plymouth, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

At the Government House at Wellington, this 26th day of
April, 1930.

His Excellency The Governor-General in Council.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution
passed by the New Plymouth Borough Council on the thir-
teenth day of February, one thousand nine hundred and
thirty, viz. :—
"That the New Plymouth Borough Council, being the
local authority having control of the street hereinafter
mentioned, hereby resolves and declares that the pro-
visions of section one hundred and twenty-eight, subsection
one, of the Public Works Act, 1928, shall not apply to
that portion of the southern side of Gill Street to which
Section 1999, New Plymouth, has frontage " ;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the southern
side of the portion of Gill Street (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-
line of the said portion of street.
SCHEDULE.
The southern side of all that portion of street situated in the
Taranaki Land District, Borough of New Plymouth, known
as Gill Street, fronting Section 1999, Town of New Plymouth.
As the said portion of street is more particularly delineated
on the plan marked P.W.D. 78287, deposited in the office of
the Minister of Public Works at Wellington, and thereon
coloured red.

The Northern Side of Portion of York Street, in the Borough
of Lower Hutt, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 26th day of
April, 1930.

His Excellency The Governor-General in Council.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Lower Hutt Borough Council on the
twenty-fourth day of March, one thousand nine hundred and
thirty, the portion of street affected by such resolution being
more particularly described in the Schedule hereto, viz. :-
"The Lower Hutt Borough Council, being the local
authority having control of the streets in the Borough of
Lower Hutt, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public Works
Act, 1928, shall not apply to that portion of York Street
adjoining Lots 3 and 4 ";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the northern
side of the portion of York Street (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-
line of the said portion of street.
SCHEDULE.
THE northern side of all that portion of street, situated in the
Wellington Land District, Borough of Lower Hutt, known as
York Street, fronting Lots 3 and 4 of a proposed subdivision
of Lots 12, 13, and 14, Block XLIX, D.P. 8193, Hutt Valley
Settlement, Block XIV, Belmont Survey District. As the
said portion of street is more particularly delineated on the
plan marked P.W.D. 78230, deposited in the office of the
Minister of Public Works at Wellington, and thereon coloured
red.
