Rules under the Industrial and Provident Societies Act, 1908.
IN exercise and pursuance of the powers and authorities conferred by the fifth section of the Industrial and Provident Societies Act, 1908, the Chief Justice of New Zealand and two other Judges of the Supreme Court of New Zealand do hereby, subject to the approval of the Governor-General in Council, make the rules set forth in the Schedule hereto, and subject to the like approval do hereby declare that the said rules shall come into force on the date of the publication thereof in the New Zealand Gazette.
SCHEDULE.
RULES RELATING TO PROCEDURE UNDER THE INDUSTRIAL AND PROVIDENT SOCIETIES ACT, 1908.
- Any society which is dissatisfied in point of law or of fact with the decision of the Registrar to refuse to register the said society or any rules thereof may, within twenty-one days after notice of the decision of the Registrar has been given to it, deliver to the Registrar a notice requiring him to state a case for the opinion of the Supreme Court.
- The Registrar shall thereupon state and sign a case accordingly, setting forth the questions of law or of fact in issue and the decision given by him, and shall deliver the case so signed to the society (hereinafter referred to as the appellant).
- The appellant shall within fourteen days after receiving the case transmit the same to the Registrar of the Supreme Court in such judicial district as the appellant thinks fit, and such Registrar of the Supreme Court shall thereupon enter the case for hearing at the first practicable sitting of the Court, and shall give notice thereof to the appellant and to the Registrar.
- On the hearing of the case the Supreme Court shall determine the questions of law or fact submitted.
- If the refusal of registry is overruled on appeal a sealed copy of the order containing the Court's decision shall be served upon the Registrar. Thereupon an acknowledgment of registry shall be given to the society by the Registrar.
- The costs of any such appeal to the Supreme Court shall be in the discretion of the Court.
