Revoking Order in Council licensing the Marbezo Products, Ltd., of Auckland, to use and occupy Part of the Foreshore and Land below Low-water Mark at the North Spit, Parengarenga Harbour, for the Purpose of taking Sand.

At the Government House at Wellington, this 14th day of April, 1930.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated the first day of June, one thousand nine hundred and twenty-nine, and published in the New Zealand Gazette, No. 45, of the thirteenth day of the same month, the Marbezo Products, Ltd., of Auckland (who, with its successors and assigns, is hereinafter called “the company”), was licensed to use and occupy a part of the foreshore below low-water mark at the North Spit, Parengarenga Harbour, for the purpose of taking sand :

And whereas it is provided in paragraph ten, subparagraph three, of the said Order in Council that, should the company fail to pay the sums specified in clauses three and four thereof the Order in Council, and every license, right, power, or privilege thereby conferred, may be determined by the Governor-General in Council without notice to the company or other proceedings whatsoever :

And whereas, the company having failed to pay any of the sums specified in clauses three and four aforesaid, it is desirable to revoke the hereinbefore-mentioned Order in Council :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the first day of June, one thousand nine hundred and twenty-nine, as from the date hereof.

The Eastern Side of Portion of Hobson Street, in the Borough of New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 14th day of April, 1930.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the seventeenth day of March, one thousand nine hundred and thirty, viz. :

“ That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply to that portion of the eastern side of Hobson Street to which Section 1977 has frontage ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Hobson Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE.

THE eastern side of all that portion of street situated in the Taranaki Land District, Borough of New Plymouth, known as Hobson Street, fronting Section 1977, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 78241, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured yellow.

The South-eastern Side of Portion of Douglas Street, in the City of Inunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 14th day of April, 1930.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twenty-sixth day of February, one thousand nine hundred and thirty, viz. :

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the south-eastern side of Douglas Street in the said City of Dunedin where such portion of street abuts on Allotments 19, 20, and 21, Block II, Township of Dalkeith ; as the said portion of street is more particularly shown on the plan annexed hereto, and is thereon coloured red to its centre-line ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Douglas Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE.

THE south-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Douglas Street, fronting Allotments 19, 20, and 21, Block II, Township of Dalkeith. As the said portion of street is more particularly delineated on the plan marked P.W.D. 78260, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
