Order in Council prescribing the Term for which the Sum of
£12,000 may be borrowed by the North Canterbury Electric-
power Board.

ORDER IN COUNCIL.
At the Government House at Wellington, this 11th day of
March, 1930.
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL.
WHEREAS the North Canterbury Electric-power Board
(hereinafter called “the said local authority”) has
been authorized to borrow in respect of a loan to be known
as “Construction and General Loan, 1927,” the sum of one
hundred and sixty thousand three hundred pounds, whereof
the sum of twelve thousand pounds has not yet been borrowed:
And whereas the Minister of Finance has given his prece-
dent consent as required by section one hundred and fourteen
of the Local Bodies’ Loans Act, 1926 (hereinafter called “the
said section”), to the borrowing by the said local authority
of the said sum of twelve thousand pounds for the term
hereinafter mentioned:
Now, therefore, His Excellency the Administrator of the
Government of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the
said Dominion, and in pursuance and exercise of the powers
and authorities conferred on him by the said section and by
section eleven of the Local Government Loans Board Act,
1926, and of all other powers and authorities enabling him
in this behalf, doth hereby prescribe that the said sum of
twelve thousand pounds may be raised in respect of the said
loan by the said local authority for a term of ten years, and
the said local authority is hereby authorized to borrow the
said sum accordingly.

Order in Council prescribing the Rate of Interest on Railway
Capital Moneys to be at the rate of four and one quarter
per Cent. per Annum.

ORDER IN COUNCIL.
At the Government House at Wellington, this 11th day of
March, 1930.

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNIL.
WHEREAS by paragraph (a) of subsection one of sec-
tion forty of the Government Railways Act, 1926
(hereinafter referred to as the said Act), it is provided that
the Governor-General may from time to time by Order in
Council determine the rates of interest to be from time to
time payable, inter alia, in terms of section thirty-eight of
that Act:
And whereas by paragraph (b) of clause three of an Order
in Council (hereinafter referred to as the said Order) made
on the twenty-second day of February, one thousand nine
hundred and twenty-six, and published in the Gazette on the
fourth day of March, one thousand nine hundred and twenty-
six, at page 536, it is provided that interest on the capital
moneys referred to in that paragraph shall be payable at the
rate of four and one-eighth per centum per annum:
And whereas it is desirable to make provision with respect
to such rate of interest as hereinafter appears:
Now, therefore, His Excellency the Administrator of the
Government of the Dominion of New Zealand, in pursuance
and exercise of the powers conferred upon him by the said
section forty of the said Act, and of all other powers and
authorities enabling him in that behalf, and acting by and
with the advice and consent of the Executive Council of the
said Dominion, doth hereby revoke the said paragraph (b) of
clause three of the said Order, and doth hereby order and de-
clare that on all capital moneys (other than the capital mones
mentioned in paragraph (a) of the said clause three) heretofore
or hereafter expended in connection with the Railways, the
rate of interest payable under paragraph (a) of subsection one
of section thirty-eight of the said Act, in respect of the
financial year ending on the thirty-first day of March, one
thousand nine hundred and thirty, and in respect of every
year thereafter, shall be four and one-quarter per centum per
annum.

Altering Date of First Meeting of Marlborough Hospital Board.

At the Government House at Wellington, this 11th day of

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL.
WHEREAS by an Order in Council made under the
Hospitals and Charitable Institutions Act, 1926, on
the twenty-first day of January, one thousand nine hundred
and thirty, and published in the Gazette of the twenty-third
day of January last, at page 158, it was, inter alia, directed
that the first meeting of the Board of the Marlborough Hos-
pital District shall be held in the Council Chamber of the
Marlborough County Council at Blenheim on the fourteenth
day of April, one thousand nine hundred and thirty, at the
hour of two o’clock in the afternoon:
And whereas it is expedient that the date of such meeting
shall be altered:
Now, therefore, His Excellency the Administrator of the
Government of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the
said Dominion, and in pursuance and exercise of the powers
conferred upon him by section one hundred and fifty-one of
the Hospitals and Charitable Institutions Act, 1926, and of
all other powers him in this behalf enabling, doth hereby
direct that the first meeting of the Board of the Marlborough
Hospital District shall be held in the Council Chamber of the
Marlborough County Council at Blenheim on the first day of
April, one thousand nine hundred and thirty, at the hour of
two o’clock in the afternoon, and the said Order in Council
is hereby revoked in so far as it conflicts with the direction
herein contained.

Authorizing the Judges of the Second Division of the Court of
Appeal to sit with the Judges of the First Division.

ORDER IN COUNCIL.
At the Government House at Wellington, this 11th day of
March, 1930.

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL.
WHEREAS by section nine of the Judicature Amend-
ment Act, 1913, it is enacted that each Division of
the Court of Appeal shall sit and exercise its jurisdiction
separately, save that in respect of any sitting of either Divi-
sion the Governor in Council may, on the certificate of two
Judges (of whom the Chief Justice shall be one) that any
appeal or other proceeding is of special difficulty or importance,
authorize all the Judges of the other Division to sit together
with those of the former Division for the hearing and determi-
nation of that appeal or proceeding:
And whereas certain questions of law have been removed
into the Court of Appeal for argument in a proceeding by way
of petition of right under the Crown Suits Act, 1908, and its
amendments, wherein Frederick John Rayner, of Auckland,
Dental Surgeon, is suppliant, and such questions of law stand
for hearing and determination before the First Division of
the Court of Appeal at the sitting commencing on the tenth
day of March, one thousand nine hundred and thirty:
And whereas the Honourable Sir Michael Myers, K.C.M.G.,
Chief Justice of New Zealand, and the Honourable Henry
Hubert Ostler, a Judge of the Supreme Court of New Zealand,
have certified that the said questions of law are of special
importance:
Now, therefore, His Excellency the Administrator of the
Government of the Dominion of New Zealand, in pursuance
of the authority vested in him in that behalf as aforesaid,
and acting by and with the advice of the Executive Council
of the said Dominion, doth hereby authorize the Judges of
the Second Division of the Court of Appeal to sit with the
Judges of the First Di-on of that Court for the hearing
and determination at the aforesaid sitting of the said questions
of law in the said proceeding.
