Sumner Borough Council.—Cancellation of unexercised Loan Authority.

In the matter of section 118 of the Local Bodies’ Loans Act, 1926.

WHEREAS the Sumner Borough Council has been duly authorized by section 176 of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1924, to borrow by way of special loan the sum of £5,000 for certain sewerage purposes, and the consent of the Governor-General in Council to the raising of the said loan was given by Order in Council made on the 10th day of February, 1926, and published in the Gazette on the 25th day of the same month at page 460:

And whereas in respect of the said sum of £5,000 there has been raised and borrowed for the purposes aforesaid the sum of £1,200:

And whereas the undertaking in respect of which the said loan was authorized has been completed, and it has not been found necessary to borrow the whole of the amount so authorized:

And whereas the Minister of Finance has duly notified the Sumner Borough Council in writing of his intention to cancel the loan authority in so far as it has not been exercised:

Now, therefore, in exercise of the powers in that behalf conferred upon me by section 118 of the Local Bodies’ Loans Act, 1926, and of all other powers me in this behalf enabling, I, George William Forbes, acting for the Minister of Finance, do hereby cancel the authority of the Sumner Borough Council to borrow under the loan authority hereinbefore referred to to the sum of £3,800, being the amount in respect of which the said loan authority has not been exercised: Provided always that this cancellation is without prejudice to the validity in all respects of the loan of £1,200 already borrowed pursuant to the said loan authority.

Plant declared to be a Noxious Weed in the Coromandel County.—(Notice No. Ag. 2877.)

THE following special order, made by the Coromandel County Council on the 16th day of December, 1929, is published in accordance with the provisions of the Noxious Weeds Act, 1928.

SPECIAL ORDER.

In exercise of the powers conferred upon it by the Noxious Weeds Act, 1928, the Coromandel County Council hereby resolves and declares, by way of special order, that the plant known as cut-leaved psoralea (psoralea pinnata) is a noxious weed within the County of Coromandel.


Making and levying Special Rates under the Swamp Drainage Act, 1915, and its Amendments.

WHEREAS by section 2 of the Swamp Drainage Amendment Act, 1928, it is enacted that the Minister of Lands may from time to time make and levy a special rate on lands in any drainage area of an amount sufficient for payment of the annual charges in respect of interest and a sinking fund of not more than one per centum per annum on so much of the moneys raised pursuant to section 4 of the Swamp Drainage Act, 1915, as has been expended on that drainage area:

And whereas by section 4 of the Swamp Drainage Amendment Act, 1926, it is enacted that the Governor-General may by Order in Council exclude any lands from the Waihi Drainage Area and redefine the boundaries of the said area, and may divide the area so redefined into two or more subdivisions; and it is thereby further enacted that any special rate to be made and levied for the said drainage area shall be made and levied separately for each subdivision as if it were a separate drainage area; and it is thereby further enacted that national-endowment lands included in the said drainage area shall be exempt from any such special rate:

And whereas by virtue of the said section 4 of the Swamp Drainage Amendment Act, 1926, as modified by the provisions of section 26 of the Finance Act, 1929, the amount of moneys raised pursuant to section 4 of the Swamp Drainage Act, 1915, that has been expended on the Waihi Drainage area is as from the 31st day of March, 1929, deemed to be the sum of £62,500:

And whereas by Order in Council made on the 21st day of February, 1927, the boundaries of the Waihi Drainage area were redefined, and the land comprised therein was divided into three subdivisions therein named and described—namely the Pukehina Subdivision, the Central Subdivision (national endowment), and the Kaikokopu Subdivision:

And whereas by Order in Council made on the 17th day of December, 1929, the aforesaid sum of £62,500 was allocated between the said several subdivisions in the proportions therein set out, so that the sum allocated to the Pukehina Subdivision is the sum of £5,000, and the sum allocated to the Kaikokopu Subdivision is the sum of £7,500:

And whereas it is expedient that provision by means of such special rates as aforesaid be made for the payment of amounts representing 5½ per centum per annum of the respective proportions (being £5,000 allocated to the Pukehina Subdivision and £7,500 allocated to the Kaikokopu Subdivision) of the said sum of £62,500 raised and expended as aforesaid:

And whereas the said 5½ per centum per annum is made up of an annual charge of 5 per centum per annum for interest and a sinking fund of ½ per centum per annum:

Now, therefore, in pursuance of the powers vested in me in that behalf by the Swamp Drainage Amendment Act, 1928, and all other powers enabling me in this behalf, I, George William Forbes, Minister of Lands, do hereby make and levy on the unimproved value of all land within the Pukehina Subdivision a special rate on a graduated scale according to the classification of such land made in accordance with section 3 of the Swamp Drainage Amendment Act, 1928, being the graduated scale set out in the First Schedule hereto:

And in further pursuance of the powers aforesaid I do hereby likewise make and levy on the unimproved value of all land within the Kaikokopu Subdivision a special rate on a graduated scale according to the classification of such land made in accordance with section 3 of the Swamp Drainage Amendment Act, 1928, being the graduated scale set out in the Second Schedule hereto:

And I declare that the foregoing respective special rates shall be annually recurring rates, and may be levied year by year without further proceeding by the Minister until the moneys in respect of which they were made (being the respective sums hereinbefore referred to) are paid off, and shall in respect of the financial year ending on the 31st day of March, 1930, be payable on the 30th day of December, 1929, and shall in respect of every future financial year be payable on the 30th day of August in such year:

And I further declare that the said respective special rates shall be payable at the office of the Collector of Rates, Chief Drainage Engineer’s Office, 5 Law Court Buildings, High Street, Auckland.

FIRST SCHEDULE.

PUKEHINA SUBDIVISION.

Class A: On the unimproved value of all lands classified as Class A by the arbitrators appointed under the said Act, sixteen pence and eighty-four one-hundredths of a penny (16d. and 84/100ths d.) in the pound.

Class C: On the unimproved value of all lands classified as Class C by the arbitrators appointed under the said Act, seven pence and forty-seven one-hundredths of a penny (7d. and 47/100ths d.) in the pound.


SECOND SCHEDULE.

KAIKOKOPU SUBDIVISION.

Class A: On the unimproved value of all lands classified as Class A by the arbitrators appointed under the said Act, three pence and fifty-eight one-hundredths of a penny (3d. and 58/100ths d.) in the pound.

Class B: On the unimproved value of all lands classified as Class B by the arbitrators appointed under the said Act, two pence and seventy-nine one-hundredths of a penny (2d. and 79/100ths d.) in the pound.

Class C: On the unimproved value of all lands classified as Class C by the arbitrators appointed under the said Act, one penny and fifty-nine one-hundredths of a penny (1d. and 59/100ths d.) in the pound.
