Order in Council consenting to the Raising by the Upper Hutt Borough Council of specified Loans on the Instalment-repayment System.

ORDER IN COUNCIL.
At the Government House at Wellington, this 9th day of September, 1929.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the local authority mentioned in the Second Column of the Schedule hereto has been authorized to borrow in respect of the loans referred to in the Third Column of the said Schedule, the respective sums stated in the Fourth Column of the said Schedule, and the said sums have not been borrowed:
And whereas the said local authority is desirous of raising the respective amounts set out in the said Fourth Column of the said Schedule upon terms of making the same, together with interest thereon, repayable by instalments extending over periods not exceeding the respective periods set out in the Fifth Column of the said Schedule.
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section thirty-two of the Local Bodies’ Loans Act, 1926, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the local authority whose name is set out in the Second Column of the said Schedule, of the loans referred to in the Third Column of the said Schedule, up to the respective amounts set out in the Fourth Column of the said Schedule, upon terms of making the same, together with interest thereon, repayable by instalments extending over periods not exceeding the respective periods set out in the Fifth Column of the said Schedule.

Consenting to a Body Corporate borrowing Money, and authorizing Payment to the Committee of Management.

ORDER IN COUNCIL.
At the Government House at Wellington, this 9th day of September, 1929.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by section three hundred and thirty-five of the Native Land Act, 1909, it is provided that, with the precedent consent of the Governor-General in Council, a body corporate constituted under Part XVII of the said Act may, on the security of a mortgage or charge of the land vested in it, borrow money for any of the purposes therein mentioned:
And whereas the body corporate constituted as aforesaid described in the Schedule hereto has applied for the precedent consent of the Governor-General in Council accordingly, and also that consent be given to any money so borrowed being paid to the committee of management of such body corporate:
And whereas the Tairawhiti District Native Land Court has recommended that such consent be granted, and it seems expedient so to do:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby, pursuant to section three hundred and thirty-five of the Native Land Act, 1909, and all other powers him enabling, grant precedent consent to the said body corporate, on the security of a mortgage or charge of the land vested in it, borrowing from a State Loan Department or from any person or body corporate, whether by cash credit in current account with a bank or otherwise, for the purpose of enabling the said body corporate to liquidate existing liabilities in respect of, and to further improve and more efficiently farm, the lands of the said body corporate, the sum set out hereunder opposite the name of such body corporate; and doth authorize the payment of any money so borrowed to the committee of management of the said body corporate; and doth consent to any instrument of alienation by way of mortgage of the lands of the said body corporate, given in pursuance of this Order in Council being confirmed by the Tairawhiti District Maori Land Board.

Revoking Dues prescribed for the Use of the Manukau County Council’s Wharf on the Wairoa River at Clevedon, Auckland, and prescribing other Dues in lieu thereof.

At the Government House at Wellington, this 9th day of September, 1929.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the seventeenth day of January, one thousand nine hundred and twenty-three, and published in the New Zealand Gazette, No. 7, of the twenty-fifth day of the same month, the Manukau County Council (hereinafter called “the Council”) was licensed to occupy a part of the foreshore and land below low-water mark at Clevedon on the Wairoa River in order to maintain thereon a wharf, in accordance with plan marked M.D. 3273, and deposited in the office of the Marine Department at Wellington:
And whereas the dues and rates to be charged and taken for the use of the said wharf were prescribed by Order in Council dated the twenty-third day of April, one thousand nine hundred and twenty-three, and published in the New Zealand Gazette, No. 40, of the third day of May, one thousand nine hundred and twenty-three:
And whereas it is desirable to revoke the said dues and rates and to prescribe others in lieu thereof:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923 (hereinafter called “the said Act”), and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the dues and rates prescribed by the hereinbefore-recited Order in Council of the twenty-third day of April, one thousand nine hundred and twenty-three, and doth also prescribe that the dues and rates set forth in the Schedule hereto shall be charged and taken by the Council for the use of the said wharf on the Wairoa River at Clevedon in lieu thereof.
SCHEDULE.
On regular trading vessels over 5 tons register: £3 3s. per annum.
On vessels other than regular traders over 5 tons register: For each time of using the wharf, 3s. 6d.
