Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by
section forty-four of the Public Reserves, Domains, and
National Parks Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby appoint

James Cameron,
Ivan Robert Keith,
Donald McPherson,
Maurice Hilton Reid, and
James Allan Sinclair

to be the Berwick Domain Board, having control of the
land described in the Schedule hereto; and doth hereby
appoint Thursday, the tenth day of October, one thousand
nine hundred and twenty-nine, at eight o’clock p.m., as the
time when, and the Public Hall, Berwick, as the place where,
the first meeting of the Board shall be held.

Order in Council under Section 118 of the Government Railways Act, 1926.

ORDER IN COUNCIL.

At the Government House at Wellington, this 26th day of
August, 1929.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS William McArley, of Wellington, is exclusively
engaged as General Secretary of the New Zealand
Locomotive Engine-drivers, Firemen, and Cleaners’ Associa-
tion:

And whereas prior to being engaged as aforesaid the said
William McArley was in the service of the New Zealand
Government Railways Department, and in respect of such
service was a contributor to the Government Railways
Superannuation Fund:

And whereas the period of engagement of the said William
McArley as General Secretary of the Association has been
continuous with his aforementioned period of service in the
Government Railways Department:

And whereas the rate of contribution paid by the said
William McArley to the Government Railways Superannua-
tion Fund when a contributor thereto in respect of his aforesaid
period of service in the Department was three per centum
of the salary or wages then received by him:

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the power and authority conferred on him by section one
hundred and eighteen of the Government Railways Act, 1926,
and of every other power and authority enabling him in that
behalf, and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby declare
and order that from and including the first day of June, one
thousand nine hundred and twenty-nine, the said William
McArley shall have and be deemed to have had all the rights,
privileges, and liabilities to which a contributor to the Govern-
ment Railways Superannuation Fund is entitled or subject
under the provisions of Part III of the Government Railways
Act, 1926; subject, however, to the provisions of the said
section one hundred and eighteen of the said Act, and to the
following express conditions, namely:—

  1. The said William McArley shall forthwith pay to the
    Government Railways Superannuation Fund the sum
    of four hundred and ninety-nine pounds ten shillings
    and threepence.

  2. The contribution of the said William McArley to the
    Government Railways Superannuation Fund shall be
    at the rate of three per centum of the salary paid to
    him by the New Zealand Locomotive Engine-drivers,
    Firemen, and Cleaners’ Association; and such con-
    tribution shall, as from and including the first day
    of June, one thousand nine hundred and twenty-
    nine, be paid to that fund at such time or times and
    by such instalments as the Minister of Railways may
    determine.

  3. In addition to the contribution payable by the said
    William McArley as specified in the last preceding
    paragraph hereof, there shall be paid to the fund by
    the New Zealand Locomotive Engine-drivers, Firemen,
    and Cleaners’ Association, or by the said William
    McArley, at such times and in such manner
    (whether by instalments or otherwise) as may be
    determined by the Minister of Railways a sum
    which in each year shall bear the same proportion
    to the total amount payable by the said William
    McArley by way of contribution to the fund in respect
    of such year as the total sum paid by the Government
    to the fund by way of subsidy bears to the aggregate
    of the sums paid into the fund by contributors under
    the Government Railways Act, 1926, in such year.

And with the like advice and consent, and in further
pursuance of the said powers and authorities, His Excellency
the Governor-General of the said Dominion doth hereby
declare that in accordance with and subject to the provisions
of subsection six of section one hundred and eighteen of the
Government Railways Act, 1926, this Order in Council shall
be subject to revocation, alteration, or amendment at any
time; and, without prejudice to the generality of the pro-
visions of this paragraph, His Excellency the Governor-
General, with the advice and consent aforesaid, doth hereby
declare in particular that this Order in Council shall be deemed
to be revoked in either of the events following, namely:—

  1. If the members of the New Zealand Locomotive Engine-
    drivers, Firemen, and Cleaners’ Association shall
    cease work on strike.

  2. If the said William McArley shall be guilty of misconduct
    which if he had been a member of the Department
    would, in the opinion of the Minister of Railways,
    have justified his dismissal from the service.

ORDER IN COUNCIL.

At the Government House at Wellington, this 2nd day of
September, 1929.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Wellington City Council (hereinafter
called “the said local authority”) has been
authorized to borrow, in respect of a loan to be known as
“Drainage and Sewerage Loan, 1928,” the sum of one hundred
and forty-eight thousand seven hundred and fifty-two pounds,
and the sum of one hundred thousand pounds has not yet
been borrowed:

And whereas the Minister of Finance has given his precedent
consent as required by section one hundred and fourteen of
the Local Bodies’ Loans Act, 1926 (hereinafter called “the
said section”), to the borrowing by the said local authority
of the said sum of one hundred thousand pounds for the term
hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
conferred on him by the said section, and of all other powers
and authorities enabling him in this behalf, doth hereby
prescribe that the said sum of one hundred thousand pounds
may be raised in respect of the said loan by the said local
authority for a term of ten years, and the said local authority
is hereby authorized to borrow the said sum accordingly.
