Amending certain Regulations made under the Local Bodies’ Loans Act, 1913.

At the Government House at Wellington, this 15th day of July, 1929.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred on him by the Local Bodies’ Loans Act, 1926 (hereinafter referred to as “the said Act”), and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the regulations made under the Local Bodies’ Loans Act, 1913, and published in the Gazette of the thirtieth day of April, one thousand nine hundred and fourteen, at page 1574, by revoking certain amending regulations made on the fifth day of March, one thousand nine hundred and twenty-eight, and published in the Gazette on the twenty-second day of the same month at page 746, and substituting the following in lieu thereof:—
SPECIAL ROLL.
(1) (a) The special roll for the part of a district for which a loan is to be raised, and which is not a legal subdivision, shall be prepared from the existing valuation roll, or, where a borough or town district is concerned, from the existing district electors’ roll or electors’ roll, the additional particulars hereby required being inserted from the existing valuation roll by the local authority proposing to raise the loan.
(b) Such special roll shall be in one or other of the following forms, as the case may require:—
(i) Form of Special Roll to be prepared where the Part of the District, not being a Borough or Town District, is not a Legal Subdivision.

Provided that the column headed “Number of Votes exercisable” shall not be required in cases where no elector is entitled to exercise more votes than one, or in cases where a loan is to be raised under paragraph (e) of section 17 of the said Act:
Provided also, that if the elector is qualified on a miner’s right the words “miner’s right” shall be entered in the column headed “Number of Section,” and no entry shall be made in the columns headed respectively, “Block,” “Area,” and “Rateable Value.”
(ii) Form of Special Roll to be prepared where Part of a Borough or Town District is not a Legal Subdivision.

(c) Where a loan is to be raised under paragraph (e) of section 17 of the said Act the special roll may, in addition, set out the capital value of each property included in such special roll, as the same appears in the existing valuation roll, or if such existing valuation roll indicates annual values only, then as the same appears in the district valuation roll for the time being in force under the Valuation of Land Act, 1925.

Appointment of Coal Creek Flat Domain Board revoked.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by an Order in Council dated the tenth day of May, one thousand nine hundred and twenty-three, and published in the Gazette of the seventeenth day of that month, a Domain Board was appointed to have control of the Coal Creek Flat Domain therein described:
And whereas it appears expedient to revoke the said Order in Council:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the Public Reserves, Domains, and National Parks Act, 1928, and of every other power and authority enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the aforesaid Order in Council dated the tenth day of May, one thousand nine hundred and twenty-three.

Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.
At the Government House at Wellington, this 15th day of July, 1929.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council gazetted, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1924:
And whereas the Land Board of the North Auckland Land District has duly passed a resolution recommending that the Tikinui Kauri-gum Reserve as described in the Schedule hereto be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation:
Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the Tikinui Kauri-gum Reserve as described in the Schedule hereto, shall from the twenty-second day of July, one thousand nine hundred and twenty-nine, cease to be subject to the Kauri-gum Industry Act, 1908.
SCHEDULE.
ALL that area in the North Auckland Land District, containing by admeasurement 1,000 acres, more or less, being the whole of the land set apart as the Tikinui Kauri-gum Reserve by Order in Council published in New Zealand Gazette of 21st December, 1898, page 2075. As the same is shown on the plan marked L. and S. 6/4/14, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
