SCHEDULE.

THE north-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Durham Street, fronting Sections 6 and 7, Block III, Township of Richmond Hill. As the said portion of street is more particularly delineated on the plan marked P.W.D. 75141, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown and edged red.

The South-western Side of Portion of Terrace Street, and the North-western Side of Portion of Seddon Street, in the City of Wanganui, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject as to a Condition to the Building-lines.

At the Government House at Wellington, this 24th day of April, 1929.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wanganui City Council on the fifth day of February, one thousand nine hundred and twenty-nine, viz.:

"The Wanganui City Council, being the local authority having control of the streets in the City of Wanganui, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the street known as Terrace Street, adjoining Lots 57, 58, 59, 60, and 61 on D.P. 802, a distance of 460·5 links, and that portion of the street known as Seddon Street adjoining Lot 57 on said D.P. 802, a distance of 159·7 links";

subject to a condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Terrace Street, or the north-western side of the portion of Seddon Street, (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.


SCHEDULE.

THE south-western side of all that portion of street situated in the Wellington Land District, City of Wanganui, known as Terrace Street, fronting Lots 57, 58, 59, 60, and 61, on D.P. 802.

Also the north-western side of all that portion of street situated in the said land district and city, known as Seddon Street, fronting Lot 57 on D.P. 802.

As the same are more particularly delineated on the plan marked P.W.D. 74694, deposited in the office of the Minister of Public Works at Wellington, and thereon edged blue.

(a) Portion of the south-eastern side of Manuka Street, where the same abuts on part Allotment 78, Township of Dunottar; and

(b) Portion of the north-eastern side of Lynwood Avenue, where the same abuts on parts Allotments 80 and 81, Township of Dunottar,

as the said portions of streets are shown on the plan annexed hereto and are thereon coloured with a pink colour to the centre-line thereof";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Manuka Street (described in the Schedule hereto), or the north-eastern side of the portion of Lynwood Avenue (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portions of streets.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 74856, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured pink.

Regulations providing for Appeals under Sections 308 and 312, Municipal Corporations Act, 1920, as amended, in respect of Buildings for Public Meetings, &c.

ORDER IN COUNCIL.

At the Government House at Wellington, this 24th day of April, 1929.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred upon him by the Municipal Corporations Act, 1920, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the regulations made under the said Act on the twenty-fifth day of October, one thousand nine hundred and twenty-seven, and published in the Gazette on the twenty-seventh day of the same month, at page 3345, and in lieu thereof doth hereby make the following regulations prescribing, pursuant to subparagraph two of paragraph four of the Eleventh Schedule to the said Act, as amended by section thirty-seven of the Municipal Corporations Amendment Act, 1928, the manner in which an appeal under the said paragraph four shall be made to a Magistrate’s Court, and doth hereby declare that such revocation shall take effect and the regulations hereby made shall come into force on the date of publication hereof in the Gazette.


REGULATIONS.

  1. IN these regulations, if not inconsistent with the context,–

"The said Act" means the Municipal Corporations Act, 1920:

"Appellant" means the applicant for a license referred to in the said Eleventh Schedule, and includes any person having under section 312 of the said Act or section 38 of the Municipal Corporations Amendment Act, 1928, the same right of appeal as is given by the said Eleventh Schedule:

"Council" means the Council of the borough within which the building is situated:

"Court" means the Magistrate’s Court, sittings of which are held in or nearest to the borough:

"License" means a license to use any building within a borough for any one or more of the purposes set out in section 308 of the said Act.
