Portion of Ocean View Terrace in the Borough of Sumner, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 19th day of February, 1929.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Sumner Borough Council on the fourteenth day of January, one thousand nine hundred and twenty-nine, viz. :—

“That the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Ocean View Terrace, containing one rood twenty perches, coloured green on the Public Works Deposit Plan Number 68267, and being part of the land shown on plan deposited in the Land Transfer Office at Christchurch as Number 9059 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting either side of the portion of Ocean View Terrace (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of Ocean View Terrace situated in the Canterbury Land District, Borough of Sumner, adjoining part R.S. 204 and connecting Heberden Avenue with the other portion of Ocean View Terrace (formerly known as Government Road). As the said portion of street is more particularly delineated on the plan marked P.W.D. 68267, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured green.

The Eastern Side of Portion of Wilton Road, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 19th day of February, 1929.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the thirteenth day of December, one thousand nine hundred and twenty-eight, viz. :—

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the eastern side of that portion of Wilton Road fronting Lots 15 and 16, deeds plan 108, and comprised in Certificates of Title 341/203 and 341/175 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Wilton Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Wilton Road, fronting Lots 15 and 16, deeds plan 108, being part Section 32, Karori District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 74169, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured blue.

The Western Side of Portion of Cascade Street, and the Northern Side of Portion of Runnell Street, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to Conditions as to the Building-lines.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the twenty-ninth day of November, one thousand nine hundred and twenty-eight, viz :—

“That the Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of street known as Cascade Street adjoining Lots 117 and 134 of Allotment 18, Section 8, Suburbs of Auckland, nor to that portion of street known as Runnell Street adjoining Lots 133 and 134 of Allotment 18, Section 8, Suburbs of Auckland ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Cascade Street (described in the Schedule hereto), within a distance of twenty feet from the centre-line of the said street, nor on the land fronting the northern side of the portion of Runnell Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said street.

SCHEDULE.

THE western side of the portion of Cascade Street, in the North Auckland Land District, City of Auckland, adjoining Lots 117 and 134 of Allotment 18, Section 8, Suburbs of Auckland.

The northern side of the portion of Runnell Street, in the said land district and city, adjoining Lots 133 and 134 of Allotment 18, Section 8, Suburbs of Auckland.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 74093, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
