Notice under the Shops and Offices Act, 1921–22, and its Amendment, fixing the Closing-hours of Chemists’ Shops within the Combined District of Auckland.
WHEREAS a requisition in writing, signed by a majority of the occupiers of all the chemists’ shops within the Combined District of Auckland, comprising the City of Auckland, the Boroughs of Birkenhead, Devonport, Mount Albert, Mount Eden, Newmarket, Northcote, Onehunga, and Takapuna, and the Town Districts of Ellerslie, Glen Eden, New Lynn, and Henderson, has been forwarded to me, desiring that all such shops within the said combined district, save and except the shop (hereinafter referred to as “the exempted shop”) established at 155 Newton Road, within the City of Auckland, for the purpose only of the sale of medicines and surgical appliances that are urgently required, be closed as set out below, and that subsection (4) of section 35 of the Shops and Offices Act, 1921–22, should not apply to any shop within two miles and a half of the exempted shop while medicines and surgical appliances are obtainable from the exempted shop—On Mondays, Tuesdays, Wednesdays, and Thursdays at 6 p.m., on Fridays at 9.30 p.m., and on Sundays from the hour of 7 a.m., with the following exceptions: (1) In the event of a day other than Saturday being observed as the statutory closing-day in any week the closing-hour on Friday in that week shall be 6 p.m., and on Saturday 9.30 p.m.; (2) on the evening of the working-day immediately preceding Good Friday the closing-hour shall be 9.30 p.m.:
And whereas I am satisfied that the signatures to such requisition represent a majority of the occupiers of all the said shops within the said combined district, and that all the occupiers of the said shops within the said combined district affected by section 35 (1) of the said Act have been afforded an equal right to share at a reasonable cost in the profits of the business carried on by the exempted shop:
Now, therefore, in pursuance of sections 32 and 35 of the Shops and Offices Act, 1921–22, and in pursuance of section 15 of the Shops and Offices Amendment Act, 1927, I, William Andrew Veitch, Minister of Labour, do hereby direct that on and after the 17th day of December, 1928, all the chemists’ shops within the Combined District of Auckland, save and except the exempted shop, shall be closed accordingly.
The notices set out in the following Schedule shall be and are hereby cancelled as from the date of the coming into operation of this notice.

NOTES: (1) Pursuant to section 21 (e) of the Shops and Offices Act, 1921–22, a chemist may keep his shop open (but only for the supply of medicines and surgical appliances) between the hours of 7 p.m. and 9 p.m. on the statutory closing-day.
(2) Pursuant to section 35 (4) of the Shops and Offices Act, 1921–22, a chemist in the combined district whose shop is more than two miles and a half from the exempted shop may supply medicines and surgical appliances that are urgently required on Sundays and on working-days outside the hours specified above: Provided that the shop is opened for such purpose only, and is closed immediately the sale is effected, and that the door of the shop is kept locked, except for the admission and exit of the customer.

WHEREAS a requisition in writing, signed by a majority of the occupiers of all the chemists’ shops within the Borough of Napier, has been forwarded to me, desiring that all such shops within the said borough, save and except the shop (hereinafter referred to as the “exempted shop”) established at Market Street, within the Borough of Napier, for the purpose only of the sale of medicines and surgical appliances that are urgently required, and known as the “Urgent Medicine Dispensary,” be closed in the evening of working days as follows—On Mondays, Tuesdays, Wednesdays, and Thursdays, at 5.30 p.m., and on Fridays at 9 p.m., with the following exception: On the working days (other than those observed as the statutory closing-day) in the period from the 20th December to the 31st December (both days inclusive) there shall be no fixed closing-hour; and, further, that subsection (4) of section 35 of the Shops and Offices Act, 1921–22, shall not apply to any chemist’s shop within two miles and a half of the exempted shop while medicines and surgical appliances are obtainable from the exempted shop:
And whereas I am satisfied that the signatures to such requisition represent a majority of the occupiers of all the said shops within the said borough, and that all the occupiers of the said shops within the said borough affected by section 35 (1) of the said Act have been afforded an equal right to share at a reasonable cost in the profits of the business carried on by the exempted shop:

The notice dated the 18th October, 1916, and published in the New Zealand Gazette of the 19th October, 1916, fixing the closing-hours of chemists’ shops in the Borough of Napier, shall be and is hereby cancelled as from the date of the coming into operation of this notice.
