Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the Local Government Loans Board Act, 1926, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan up to the amount of five thousand eight hundred and ten pounds for a term of twenty years, at such rate or rates of interest as shall not produce to the lenders a rate exceeding the rate of five pounds ten shillings per centum per annum, subject to the condition that the said local authority shall, before borrowing the said sum or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies’ Loans Act, 1926, and by making to such sinking fund payments at intervals of not more than one year at a rate or rates which shall be not less than the rate of three pounds per centum, such payments to be made in respect of every part of the said sum for the time being so borrowed and not repaid, and the first payment to be made not later than one year after the first day from which interest to the lender is computed on any moneys so borrowed, and subject to the further condition that no portion of interest or sinking fund shall be paid out of loan-moneys.

The Western Side of Portion of Sydenham Street, and the Southern and South-eastern Side of Portion of Lambeth Road, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of December, 1928.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolutions passed by the Wellington City Council on the thirteenth day of September, one thousand nine hundred and twenty-eight, viz:—

“ The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the western side of that part of Sydenham Street fronting Lot 50, A2184, being part Section 31, Karori Registration District ”;

“ The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the southern and south-eastern side of that part of Lambeth Road fronting Lots 48, 49, and 50, A2184, being part Section 31, Karori Registration District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Sydenham Street or the southern and south-eastern side of the portion of Lambeth Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE western side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Sydenham Street, fronting Lot 50, being part Section 31, Karori R.D.

Also the southern and south-eastern side of all that portion of street in the said land district and city known as Lambeth Road, fronting Lots 48, 49, and 50, being part Section 31, Karori R.D.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 73998, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portion of Hardy Street, in the City of Nelson, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the sixteenth day of November, one thousand nine hundred and twenty-eight, viz:—

“ That the Nelson City Council, being the local authority having control of the streets in the City of Nelson, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the portion of the street known as Hardy Street (both sides) between Tasman Street and Vanguard Street ”;

such portion of street being described in the Schedule hereto.

SCHEDULE.

ALL that portion of street situated in the Nelson Land District, City of Nelson, known as Hardy Street, extending from Vanguard Street to Tasman Street. As the same is more particularly delineated on the plan marked P.W.D. 74009, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Lawrence Street, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the fifteenth day of November, one thousand nine hundred and twenty-eight, viz.:—

“ The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the southern side of that portion of Lawrence Street, beginning at a point 143·94 links from the intersection of Lawrence and Owen Streets, and extending for a distance of 69·41 links in an easterly direction, being that portion of Lawrence Street fronting part section 868, Town of Wellington, and shown on C.T. 96/66 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Lawrence Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE southern side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Lawrence Street, fronting part Section 868, Town of Wellington. As the same is more particularly delineated on the plan marked P.W.D. 73922, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
