New Zealand Education Department.—Standard Scheme of Control for Secondary Schools.

PART I.—PRELIMINARY.

  1. THESE presents may be referred to as “the Standard Scheme of Control for Secondary Schools.”

  2. In this scheme, where not inconsistent with the context,—
    “The Education Acts” means the Education Act, 1914, and includes the amendments thereof and all regulations lawfully made thereunder and for the time being in force:
    “The School Acts” includes the Education Acts and any special Acts constituting the school or affecting the constitution thereof and all regulations lawfully made thereunder respectively and for the time being in force:
    “The Minister” means the Minister of Education:
    “The Board” means the governing body however described of any secondary school:
    “Member” means a member of any Board:
    “A pupil of the school” means a pupil whose name is on the school roll, including a pupil of a junior high school forming an intermediate department of the school, but does not include a pupil in any lower department:
    “Parent of a pupil” includes a pupil’s guardian and the householder in whose family the pupil resides, and includes both the father and mother of a pupil:
    “Secretary” includes the Registrar, Clerk, Acting-Secretary, and any other person appointed permanently or temporarily to discharge the duties of a secretary to the Board.

  3. If more than one separate educational establishment is maintained by the Board, all such establishments shall be deemed one “school” for the purposes of this scheme, but “Principal” means the respective rector, headmaster, headmistress, or other principal of each such establishment separately.

  4. This scheme shall in all respects be read subject to the provisions of the School Acts, and in the event of conflict between the provisions of this scheme and the provisions of the School Acts the latter provisions shall prevail.

PART II.—APPOINTMENT AND ELECTION OF MEMBERS.

Appointment of Members by Education Boards.

  1. In every case where a member is to be appointed by the Education Board of the district in which the school is situated every such member shall be appointed by a resolution of the Education Board passed in the case of a regular biennial appointment before the day on which the member so appointed is to assume office, but not more than three months before that day, and in the case of a casual vacancy within fifty days after the fact of the vacancy has been notified to the Education Board.

  2. The name of every member so appointed shall forthwith be notified to the Board by writing under the hand of the Secretary of the Education Board.

Appointment of Members by Borough Councils.

  1. In every case where a member is to be appointed by the Council of the nearest borough within five miles of the school every such member shall be appointed by a resolution of such Council passed in the case of a regular biennial appointment before the day on which the member so appointed is to assume office, but not more than three months before that day, and in the case of a casual vacancy within fifty days after the fact of the vacancy has been notified to such Council.

  2. The name of every member so appointed shall forthwith be notified to the Board by writing under the hand of any two Councillors or the Town Clerk of such Council.

  3. If any question arises as to which is in fact the nearest borough within five miles of the school such question may be decided by the Minister on the application of the Board or of any Borough Council claiming to be interested.

Election of Members by Parents.

  1. In every case where any member is to be elected by the parents of pupils every such member shall be elected by means of an election conducted in the manner set out in the schedule hereto, and for the purposes of every such election the Secretary of the Board shall be the Returning Officer.
