HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the twenty-eighth day of June, one thousand nine hundred and twenty-six, and published in the New Zealand Gazette No. 45 of the first day of the following month, Mijo Jovich, of Ruakaka (who with his executors, administrators, and assigns is hereinafter called “the licensee”), was licensed to use and occupy part of the foreshore below low-water mark on the Ruakaka River, Whangarei County, as a site for timber-booms :
And whereas the said licensee has applied to have the hereinbefore-recited license revoked, and it is desirable to revoke the same :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the twenty-eighth day of June, one thousand nine hundred and twenty-six, as from the thirty-first day of March, one thousand nine hundred and twenty-eight.

Vesting the Control of a Reserve in the Nevis Public Library Board.

ORDER IN COUNCIL.
At the Government House at Wellington, this 30th day of November, 1928.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the land described in the Schedule hereto is a reserve duly set apart for a site for a library : And whereas it is expedient that the control of the said reserve should be vested in a special Board as hereinafter provided :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section two of the Public Reserves and Domains Amendment Act, 1914, doth hereby vest the control of the reserve described in the Schedule hereto for the period of five years from the date hereof (unless previously amended or revoked under the said Act) in the undermentioned persons, namely :—
Henry Alexandra Dickey,
Ellis John Williams, and
Robert Ritchie,
who are hereby constituted for that purpose a special Board by the name of the Nevis Public Library Board (hereinafter referred to as “the Board”), with the powers and subject to the conditions hereinafter contained, that is to say :—

The Board shall meet for the transaction of business on the last Friday in each month at eight o’clock p.m., at the Nevis Public Library, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Friday, the twenty-eighth day of December, one thousand nine hundred and twenty-eight.

The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

Special meetings may be convened by the Chairman, provided that two days’ notice of any such meeting is given to each member, specifying the business to be transacted at such special meeting ; and no other business than that so specified shall be transacted at such meeting. Any meeting may be adjourned from time to time.

If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

The Board shall have prepared and submitted at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

The Board shall control the said reserve and the building erected thereon for the purposes of a public library, and shall also afford settlers and residents of Nevis and the surrounding district such facilities for meeting within the said building as may from time to time be determined by the Board, provided that the Board shall have power to fix reasonable charges for the use of the said building.

Validating Proceedings in connection with the Horowhenua County Council’s Waihau Road Special-rating District Loan of £450.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the Horowhenua County Council, in pursuance of the powers contained in section seventeen of the Local Bodies’ Loans Act, 1926 (hereinafter referred to as “the said Act”), lately proceeded by way of special order to raise a loan of four hundred and fifty pounds (hereinafter referred to as “the said loan”) for the purpose of forming and metalling the Waihau Road :
And whereas section eighteen of the said Act requires the special roll to be deposited not less than seven days before any steps are taken under section seventeen :
And whereas the special roll was not deposited not less than seven days before the written consent of the ratepayers was obtained :
And whereas the description of the special-rating area as given in the special order and in the public notice thereof is irregular or defective in that it omits Lot 21, deposited plan No. 2291 of Horowhenua 3c1, Block II, Waiopehu Survey District :
And whereas it appears that the ratepayers have not been misled by the irregularities or defects aforesaid, and it is expedient to validate the same :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and twenty-two of the Local Bodies’ Loans Act, 1926, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings taken shall be valid to all intents and purposes as though the provisions of section eighteen had been properly complied with, and as though the special-rating area had been properly described in the special order and in the public notice thereof, and that the validity of the proceedings in connection with the said loan shall not be called into question by reason only of the irregularities or defects aforesaid.
