Revoking Part of a Proclamation taking Land for the Kaipara-Waikato Railway (Auckland-Westfield Deviation).

A PROCLAMATION.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Proclamation taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect to the taking thereof, it is found that the land or any part thereof is not required for the purpose for which it was taken, the Governor-General may, by a subsequent Proclamation gazetted, revoke the former Proclamation, either wholly or so far as he thinks necessary:

And whereas it is found that part of the land taken for the purposes of the Auckland-Westfield Deviation of the Kaipara-Waikato Railway by a Proclamation made under the Public Works Act, 1908, dated the ninth day of June, one thousand nine hundred and twenty-three (hereinafter termed “the said Proclamation”), and published in the New Zealand Gazette No. 53, of the fourteenth day of June, one thousand nine hundred and twenty-three, page 1633, is not required for the purposes for which it was taken:

Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf, do hereby revoke so much of the said Proclamation as affects the land described in the Schedule hereto.

SCHEDULE.

APPROXIMATE area of the piece of land: 1 rood 22·3 perches. Portion of Railway Reserve (part Lot 6, D.P. 10398), Block II, Otahuhu Survey District, Mount Wellington Road District. (S.O. 24593, blue.)

In the North Auckland Land District; as the same is more particularly delineated on the plan marked W.R. 39816, deposited in the office of the Minister of Railways at Wellington, and thereon coloured yellow.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 15th day of October, 1928.

A PROCLAMATION.

IN pursuance and exercise of the powers conferred by section twelve of the Land Act, 1924, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, do hereby proclaim as a road the land described in the First Schedule hereto; and also do hereby proclaim as closed the road described in the Second Schedule hereto.

FIRST SCHEDULE.

LAND PROCLAIMED AS A ROAD.

APPROXIMATE areas of the pieces of land proclaimed as a road:—

2 2 18·2 Section 3s, Fairfield Settlement, and Lot 2, D.P. 5554 of Rural Section 294, Township of Carnarvon; coloured green.

All situated in Block IV, Te Kauwau Survey District.

All in the Wellington Land District: as the same are more particularly delineated on the plan marked L. and S. 21/34, deposited in the Head Office, Department of Lands and Survey at Wellington, under No. 2274, and thereon coloured as above mentioned.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 20th day of October, 1928.
