THE WESTPORT BOROUGH COUNCIL.

By-law No. 1.—Re Parking Vehicles, &c.

IN pursuance and exercise of the powers and authorities vested in it by the Municipal Corporations Act, 1920, and of each and every other power thereto enabling it, the Westport Borough Council makes and ordains this by-law.

PRELIMINARY.

  1. This by-law may be cited or referred to as the Westport Borough By-law No. 1, re Parking Vehicles, &c., and it shall apply within the Borough of Westport.

INTERPRETATION.

  1. In this by-law, except where repugnant to or inconsistent with the context,—

“Borough” means the Borough of Westport :

“Driver” of any vehicle includes the person for the time being engaged or employed in driving or of being in charge of such vehicle :

“Footpath” means so much of any street as is formed or constructed or laid out by authority of the Council for foot traffic or foot-passengers only, and includes the edging or kerbing thereof :

“Motor-vehicle” includes any vehicle propelled by mechanical power :

“Public motor-vehicle” means a motor-vehicle which is plied for hire :

“Vehicle” means any conveyance, engine, or machine, on wheels propelled or designed to be propelled by manual, horse, or mechanical power, but does not include a bicycle, perambulator, or invalid’s chair.

  1. No vehicle shall be parked or be allowed to remain stationary for a longer time than five minutes in Palmerston Street between Fonblanque Street and Cobden Street, or in Wakefield Street between Palmerston Street and Russell Street, or in Brougham Street between Palmerston Street and Peel Street, or in Lyndhurst Street between Palmerston Street and Russell Street, except in the middle of the street and parallel with the line of the street. (Where the surface of the road is tarred or asphalted the middle of the street will be indicated by a white line.)

  2. No vehicle shall be allowed to remain stationary in any street except parallel with the line of such street and (when not in the middle of the street) at a distance of not more than 1 ft. from the kerbing of the nearer footpath.

  3. In no case shall a vehicle be parked or allowed to remain stationary in any street within 30 ft. of the intersection of such street with any other street.

  4. Every vehicle while being driven along any street shall be kept to the left, and shall not cross the middle-line of such street except at a street intersection. (A driver intending to take his vehicle to the side of a street opposite to the side on which he is driving shall drive the vehicle forward to an intersection and there cross over, keeping on his right hand side the central point of the intersection.)

  5. The driver or person in charge of any vehicle while in any street shall, at the request of any police officer, traffic inspector, or other officer or person duly authorized in that behalf, remove such vehicle to such place as such police officer, traffic inspector, or other officer or authorized person shall or may direct. Before moving his vehicle in accordance with any such direction as aforesaid the driver or person in charge of the vehicle may require production of the authority in that behalf of any such officer or authorized person other than a police officer or traffic inspector.

  6. The stand or parking-place of public motor-vehicles shall be only in Brougham Street, between Palmerston Street and the Government Railway-station, and the middle-line of that section of Brougham Street shall be reserved as an exclusive stand or parking-place for public motor-vehicles.

  7. No portion of Palmerston Street shall be used as a stand or parking-place for any public motor-vehicle.

The foregoing by-law was duly made by the Westport Borough Council by a special order passed on the 2nd day of May, 1928, and confirmed on the 6th day of June, 1928.
