“That the Auckland City Council, having control of Richard Street, Auckland, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the said street, fronting portion of Allotment 11, Section 9, Suburbs of Auckland ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said street.

SCHEDULE.

ALL that street in the North Auckland Land District, City of Auckland, known as Richard Street, adjoining or passing through part Allotment 11, Section 9, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 69257, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Land District, and thereon coloured red.

At the Government Buildings at Wellington, this 26th day of January, 1928.

WHEREAS by section nine of the Mining Act, 1926, it is enacted that the Governor-General may from time to time, by Order in Council, appoint fit persons to be Wardens, who shall hold office during the Governor-General’s pleasure :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred by the said section nine of the Mining Act, 1926, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Stanley Logan Paterson, Esquire,

to be a Warden, to hold and exercise the duties of such office under and subject to the provisions of the said Act during pleasure, on and from the first day of February, one thousand nine hundred and twenty-eight.

Prescribing the Term for which the Nelson City Council may borrow the Sum of £475, authorized to be raised for the Purpose of completing the Construction of Swimming-baths, and also the Rate of Interest payable thereon.

At the Government Buildings at Wellington, this 26th day of January, 1928.

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS by section one hundred and fourteen of the Local Bodies’ Loans Act, 1926, it is provided that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money, or any part thereof, has not been borrowed, the local authority or public body may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term, as may be prescribed by the Governor-General by Order in Council :

And whereas the Nelson City Council has been authorized to borrow the sum of four hundred and seventy-five pounds for the purpose of completing the construction of swimming-baths :

And whereas the Minister of Finance has given his precedent consent as required by the above-recited section one hundred and fourteen, and it is desired that the term for which the money may be borrowed be fifteen years, and the rate of interest payable thereon be not exceeding five and three-quarters per centum per annum :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the term for which the Nelson City Council may borrow the said sum of four hundred and seventy-five pounds shall be fifteen years, and the rate of interest that may be paid thereon shall be a rate not exceeding five and three-quarters per centum per annum, and the said Nelson City Council is hereby authorized to borrow the said sum of four hundred and seventy-five pounds accordingly.
