Pursuant to section 13 of the Local Bodies’ Loans Act, 1926, I hereby give notice that at a poll of the ratepayers of the Borough of Birkenhead, taken on the 28th day of June, 1928, on the proposal of the Birkenhead Borough Council to borrow the sum of £5,230 for the purpose of augmenting and extending water reticulation, the number of votes recorded for the proposal was 378; the number of votes recorded against the proposal was 247.

I therefore declare that the proposal was carried.

Pursuant to section 13 of the Local Bodies’ Loans Act, 1926, I hereby give notice that at a poll of the ratepayers of the Borough of Birkenhead, taken on the 28th day of June, 1928, on the proposal of the Birkenhead Borough Council to borrow the sum of £3,250 for the purpose of acquiring recreation-ground and constructing swimming-pool, the number of votes recorded for the proposal was 242; the number of votes recorded against the proposal was 375.

I therefore declare that the proposal was rejected.

Notice under the Shops and Offices Act, 1921–22, and its Amendment, fixing the Closing-hours of Fishmongers’ Shops within the Borough of Napier.

WHEREAS a requisition in writing, signed by a majority of the occupiers of all the fishmongers’ shops within the Borough of Napier, has been forwarded to the Minister of Labour, desiring that all such shops within the said borough be closed in the evening of working-days as follows: On Mondays, Tuesdays, Wednesdays, Thursdays, Fridays, and Saturdays at 6 p.m., with the following exceptions—On the working-day next preceding Christmas Day, on the working-day next preceding New Year’s Day, and on the working-day next preceding Good Friday, there shall be no fixed closing-hour:

And whereas the Minister of Labour is satisfied that the signatures to such requisition represent a majority of the occupiers of all the said shops within the said borough:

Now, therefore, in pursuance of section 32 of the Shops and Offices Act, 1921–22, I, for and on behalf of the Minister of Labour, do hereby direct that on and after the 20th day of August, 1928, all the fishmongers’ shops within the Borough of Napier shall be closed accordingly.

Notice under the Shops and Offices Act, 1921–22, and its Amendment, fixing the Closing-hours of Grocers’ Shops within the Borough of Hastings.

WHEREAS a requisition in writing, signed by a majority of the occupiers of all grocers’ shops within the Borough of Hastings, has been forwarded to the Minister of Labour, desiring that all such shops within the said borough be closed in the evening of working-days as follows: On Mondays, Tuesdays, Thursdays, and Fridays, at 5.30 p.m., and on Saturdays at 8.30 p.m.: Provided that should the occupier of any shop affected by this requisition observe, pursuant to section 14 (2) of the Shops and Offices Act, 1921–22, Saturday as the statutory closing-day then, and in such case, the closing-hour on Wednesday for any such shop shall be 5.30 p.m., and the closing-hour on Friday shall be 8.30 p.m.:

And whereas the Minister of Labour is satisfied that the signatures to such requisition represent a majority of the occupiers of all the said shops within the said borough:

Now, therefore, in pursuance of section 32 of the Shops and Offices Act, 1921–22, I, for and on behalf of the Minister of Labour, do hereby direct that on and after the 20th day of August, 1928, all the grocers’ shops within the Borough of Hastings shall be closed accordingly.

The notice dated the 14th September, 1909, and published in the New Zealand Gazette of the 16th September, 1909, fixing the closing-hours of grocers’ shops in the Borough of Hastings shall be and is hereby cancelled as from the date of the coming into operation of this notice.

Notice under the Shops and Offices Act, 1921–22, and its Amendment, fixing the Closing-hours of Chemists’ Shops within the Borough of Palmerston North.

WHEREAS a requisition in writing, signed by a majority of the occupiers of all the chemists’ shops within the Borough of Palmerston North, has been forwarded to the Minister of Labour, desiring that all such shops within the said borough, save and except the shop established at Main Street, within the Borough of Palmerston North, for the purpose only of the sale of medicines and surgical appliances that are urgently required, and known as the “Urgent Medicine Dispensary,” be closed in the evening of working-days as follows: On Mondays, Tuesdays, Thursdays, and Fridays not later than 6 p.m.; Saturdays, 10 p.m.; and, further, that pursuant to section 15 of the Shops and Offices Amendment Act, 1927, all chemists’ shops save and except that shop known as the “Urgent Medicine Dispensary” shall be closed on Sundays from the hour of 6 a.m. for the remainder of the day, with the following exceptions: 1. (a) The working-day immediately preceding Christmas Day and New Year’s Day, 11 p.m.; (b) the working-day immediately preceding Good Friday, 10 p.m.; 2. Should the occupier of any shop bound by the provisions of this requisition observe, pursuant to the provisions of section 26 of the Shops and Offices Act, any two days in any one week other than Wednesday as closing-days, in such case the closing-hour for any such shop on Wednesday of that week shall be 6 p.m.; and, further, that subsection (4) of section 35 of the Shops and Offices Act, 1921–22, shall not apply to any chemist’s shop within the radius of two miles and a half while medicines and surgical appliances are obtainable from such specified shop:

And whereas the Minister of Labour is satisfied that the signatures to such requisition represent a majority of the occupiers of all the said shops within the said borough, and that all the occupiers of the said shops within the said borough affected by section 35 (i) of the said Act have been afforded an equal right to share at a reasonable cost in the profits of the business carried on by the exempted shop:

Now, therefore, in pursuance of sections 32 and 35 of the Shops and Offices Act, 1921–22, and in pursuance of section 15 of the Shops and Offices Amendment Act, 1927, I, for and on behalf of the Minister of Labour, do hereby direct that on and after the 20th day of August, 1928, all the chemists’ shops within the Borough of Palmerston North, save and except the shop (hereinafter referred to as the “exempted shop”) established at Main Street within the said Borough for the purpose only of the sale of medicines and surgical appliances that are urgently required, and known as the “Urgent Medicine Dispensary,” shall be closed on Mondays, Tuesdays, Thursdays, and Fridays at 6 p.m., on Saturdays at 10 p.m., and, pursuant to section 15 of the Shops and Offices Amendment Act, 1927, on Sundays at 6 a.m., with the following exceptions: (1) On the working-day immediately preceding Christmas Day and on the working-day immediately preceding New Year’s Day, the closing-hour shall be 11 p.m.; (2) on the Thursday immediately preceding Good Friday, the closing-hour shall be 10 p.m.; (3) should the occupier of any shop affected by this notice close his shop in any week during the whole of any two working-days other than Wednesday, then and in such case the closing-hour on Wednesday shall be 6 p.m.; (4) subsection (4) of section 35 of the Shops and Offices Act, 1921–22, shall not apply to any chemist’s shop which is within a distance of two miles and a half from the exempted shop while medicines and surgical appliances are obtainable from the exempted shop.

The notice dated the 22nd May, 1918, and published in the New Zealand Gazette of the 23rd May, 1918, fixing the closing-hours of chemists’ shops in the Borough of Palmerston North, shall be and is hereby cancelled as from the date of the coming into operation of this notice.

Dated at Wellington, this 27th day of July, 1928.

NOTES.—(1) Pursuant to section 21 (e) of the Shops and Offices Act, 1921–22, a chemist may keep his shop open (but only for the supply of medicines and surgical appliances) between the hours of 7 p.m. and 9 p.m. on the statutory closing-day.

(2) Pursuant to section 35 (4) of the Shops and Offices Act, 1921–22, a chemist in the borough whose shop is more than two miles and a half from the exempted shop may supply medicines and surgical appliances that are urgently required on Sundays and on working-days outside the hours specified above: Provided that the shop is opened for such purpose only, and is closed immediately the sale is effected, and that the door of the shop is kept locked, except for the admission and exit of the customer.
