Authorizing the Takapuna Borough Council to reclaim Land in Wairau Creek Estuary for a Road.

ORDER IN COUNCIL.
At the Government House at Wellington, this 9th day of July, 1928.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS it is provided by the one hundred and sixty-eighth section of the Harbours Act, 1923 (hereinafter called “the said Act”), that the Governor-General may from time to time, by Order in Council, authorize any local authority or Harbour Board to reclaim from the sea areas not exceeding five acres in extent in any case where he considers that the reclamation will not affect navigation and is for the benefit of the public :

And whereas the Takapuna Borough Council (hereinafter called “the Council”) is desirous of reclaiming from the sea certain land in the Wairau Creek Estuary, and the said reclamation is of such a nature as aforesaid, and the Council has applied to the Governor-General in Council for an Order authorizing the execution of the said work :

And whereas it has been made to appear to the Governor-General in Council that the proposed work will not be or tend to the injury of navigation, and is for the benefit of the public :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize and empower the Council to reclaim from the sea in the Wairau Creek Estuary, the land shown coloured blue on plan marked M.D. 6478, and deposited in the office of the Marine Department at Wellington; such reclamation to be carried out and constructed in accordance with plan M.D. 6478, subject to the provisions of the said Act.

Authorizing the Exchange of Part of a Lighthouse Reserve in Block V, Arapawa Survey District, Marlborough Land District, for other Land.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the First Schedule hereto forms part of a reserve duly set apart for lighthouse purposes: And whereas it is expedient that the said land should be exchanged for the land described in the Second Schedule hereto, which the Governor-General deems of equal value and more suitable for the purposes of the reserve :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section twelve of the Public Reserves and Domains Act, 1908, doth hereby declare that the land described in the First Schedule hereto may be exchanged for the land described in the second Schedule hereto.

FIRST SCHEDULE.

DESCRIPTION OF PART OF RESERVE AUTHORIZED TO BE EXCHANGED.

ALL that area in the Marlborough Land District containing by admeasurement 35 perches, being Lot 1 of Section 4, Block V, Arapawa Survey District, and being the lands hereinafter described as follows:—

The northern moiety of aforesaid Lot 1 is bounded to the north-east and south-east by Lot 2 of 4, Block V aforesaid, 152·8 links and 25·4 links, respectively; and towards the south-west and north-west by Wekenui 3A, Native Block, 148·2 and 25 links respectively :

The southern moiety of aforesaid Lot 1 is bounded towards the north-west and north-east by Lot 2 of 4 aforesaid, 25·4 links and 720·6 links, respectively; towards the south-east by high-water mark of Wekenui Bay, 25 links; and towards the south-west partly by the abuttal of a public road, 100 links, and partly by Wekenui 3A, Native Block, 624·5 links :

Be all the aforesaid linkages a little more or less. As the same is more particularly delineated on plan marked L. and S. 6/10/15, deposited in Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

SECOND SCHEDULE.

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.

ALL that area in the Marlborough Land District containing by admeasurement 1 acre 1 rood 7 perches, being a portion of Wekenui 3A, Native Block. Situated in Block V, Arapawa Survey District, and bounded as follows: Towards the south-west, north-west, and north-east by the remaining portion of Wekenui 3A aforesaid, 538·2 links, 103 links, and 404·4 links, respectively; and towards the south-east by Lot 2 of 4 aforesaid, 535·2 links: Be all the aforesaid linkages a little more or less. As the same is more particularly delineated on plan marked L. and S. 6/10/15, deposited in Head Office, Department of Lands and Survey, at Wellington, and thereon bordered green.

Domain Board appointed to have Control of the Kowai Domain.

IN pursuance and exercise of the powers conferred by section forty of the Public Reserves and Domains Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Frederick Polhill Coleman,
Frank Hubert Courage,
Gordon Fulton,
George Dean Greenwood,
William Henry Hale,
William Alexander Kelcher, and
George Norman McLean

to be the Kowai Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Monday, the sixth day of August, one thousand nine hundred and twenty-eight, at ten o’clock a.m., as the time when, and the Secretary’s Office, Amberley, as the place where, the first meeting of the Board shall be held.

SCHEDULE.

CANTERBURY LAND DISTRICT.—KOWAI DOMAIN.

RESERVE 2066 (in red), Block VIII, Grey Survey District: Area, 214 acres 1 rood.
