SCHEDULE.
LINCOLN PARK DOMAIN.

All that area in the Canterbury Land District containing by admeasurement 10 acres, more or less, being Reserve No. 4200 (formerly part Lot 2, deposit plan No. 1788), situated in Block V, Halswell Survey District, and bounded as follows: Towards the west by Lot 4 on said deposit plan No. 1788, 1570·2 links; towards the north and east by other parts of Lot 2 on said deposit plan No. 1788, 636·9 and 1569·9 links, respectively; and again towards the south by the Lincoln Town Belt, 636·9 links: As the same is more particularly delineated on the plan marked L. and S. 1/877, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Extending Time for holding Election of Trustees for Lower Mangapiko Drainage District.

At the Government House at Wellington, this 2nd day of July, 1928.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section ten of the Land Drainage Act, 1908, it is provided that on the first Monday in the month of November in the year following the year in which the first trustees for any drainage district are elected, and on the same day in each succeeding third year thereafter, an election of trustees for each district shall be held:

And whereas an election of trustees for the Lower Mangapiko Drainage District should have been held on the seventh day of November, one thousand nine hundred and twenty-seven:

And whereas it is expedient to extend the time for holding such election of trustees for the Lower Mangapiko Drainage District:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the powers and authorities vested in him by section twenty-two of the Land Drainage Amendment Act, 1922, and of all other powers in anywise enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby extend the time for holding the aforesaid election of trustees for the Lower Mangapiko Drainage District; and doth hereby order and declare that in the aforesaid drainage district the said election shall be held and take place on Thursday, the second day of August, one thousand nine hundred and twenty-eight.

Order in Council regulating the Use of Nets for taking Fish in certain Waters.

ORDER IN COUNCIL.

At the Government House at Wellington, this 25th day of June, 1928.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated the thirtieth day of August, one thousand nine hundred and twenty-six, and published in the New Zealand Gazette No. 59 of the second day of September, one thousand nine hundred and twenty-six, regulations were made regulating the use of seine nets for taking fish within the Firth of Thames and within Manukau Harbour:

And whereas it is desirable to amend the said regulations:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by section five of the Fisheries Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke regulation number four of the hereinbefore-recited regulations, and doth hereby make the following regulations, which shall have force and effect throughout New Zealand.

REGULATIONS.

  1. No person shall use a Danish seine net the mesh of which in the last three yards of the cod-end measures, when prepared for use, less than four and a half inches.

  2. Any person committing a breach of the preceding regulation shall be liable to a fine of fifty pounds.

Prohibiting the Use of Danish Seine or Purse-seine Nets in Queen Charlotte and Pelorus Sounds.

At the Government House at Wellington, this 25th day of June, 1928.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS it is enacted by the fifth section of the Fisheries Act, 1908 (hereinafter called “the said Act”), that the Governor-General in Council may from time to time make regulations, which shall have general force and effect throughout the Dominion, or particular force and effect only in any waters or places specified therein, for, amongst other things, prescribing conditions and restrictions for the regulating of fishing and the taking of fish, and for prohibiting the use of any particular engines, tackles, or apparatus for taking any fish:

And whereas it is desirable to prohibit the taking of fish by Danish seine nets or by purse-seine nets and the use of such mentioned nets in Queen Charlotte and Pelorus Sounds:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the hereinbefore-recited power and authority, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations for the purposes of the said Act.

REGULATIONS.

  1. No person shall haul or use a Danish seine net or a purse-seine net for the purpose of taking fish in Queen Charlotte and Pelorus Sounds within straight lines drawn from the West Head to East Head of Tory Channel, and from Cape Koamaru to Cape Jackson, and thence to Harding Point: As the said area is delineated on the plan marked M.D. 5578, deposited in the office of the Marine Department at Wellington, in the Provincial District of Wellington.

  2. Any person committing a breach of clause 1 of these regulations is liable to a penalty not exceeding twenty pounds.

Recreation Reserve in North Auckland Land District brought under Part II of the Public Reserves and Domains Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 2nd day of July, 1928.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

BY virtue of the powers and authorities vested in me by the twenty-sixth section of the Public Reserves and Domains Act, 1908, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the North Auckland Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of, and declared to be subject to, the provisions of Part II of the said Act; and such reserve shall hereafter be known as the Mangapai Domain, and be managed, administered, and dealt with as a public domain.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.—MANGAPAI DOMAIN.

Lot 1, D.P. 12964, portion of Allotment 43, Parish of Ruarangi, and being all the land comprised in certificate of title, Vol. 321, folio 172, Auckland Registry: Area, 13 acres 2 roods 10 perches, more or less.
