enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing by the Leamington Town Board of the sum of two thousand three hundred and fifty pounds (£2,350) for the purpose of installing a domestic water-supply in the town district, subject to the following conditions:—

  1. That the said sum may be borrowed for a term not exceeding thirty (30) years.

  2. That the Leamington Town Board shall, before borrowing the said sum or any part thereof, make provision for the repayment of the said sum by establishing a sinking fund under the Local Bodies' Loans Act, 1926, and by making to such sinking fund payments at intervals of not more than one year, at a rate which shall be not less than one pound ten shillings (£1 10s.) per centum, such payments to be made in respect of every part of the said sum for the time being so borrowed and not repaid, and the first payment to be made not later than one year after the first day from which interest to the lender is computed on any moneys so borrowed.

  3. That no portion of interest or sinking fund shall be paid out of loan-money.

IN pursuance and exercise of the powers vested in him by the Public Works Amendment Act, 1911, and clause twenty-seven of the Electrical Supply Regulations, 1927, published in the New Zealand Gazette of the twelfth day of July, one thousand nine hundred and twenty-seven, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the assignment to David Henderson Rutherford, of Masterton, Sheep-farmer, by Alexander John Cameron, Settler, Makuri, of the latter's rights, powers, and privileges under the Order in Council dated the sixth day of December, one thousand nine hundred and fifteen, authorizing the latter to take and use water from the Turakina Stream for the purpose of generating electricity and to erect electric-lines within portion of the Pahiatua County.

Netherton Drainage District, County of Hauraki Plains, constituted.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day of June, 1928.

Present:
THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS in accordance with the provisions of the third section of the Land Drainage Act, 1908, a majority of the ratepayers in the area of land described in the Schedule hereto, situated within the County of Hauraki Plains, have presented a petition to His Excellency the Governor-General of the Dominion of New Zealand, praying that the said area be constituted a drainage district under the provisions of the said Act:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority contained in the third section of the Land Drainage Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby constitute and declare the area of land described

in the Schedule hereto to be a district for the purposes of Part I of the said Act, and to be called by the name of the “Netherton Drainage District”; and also, in pursuance and exercise of the power and authority contained in the fourth section of the said Act, doth hereby declare that the Board of Trustees of the said district shall consist of five persons to be elected as members of the said Board, and under and in accordance with the said Act.

SCHEDULE.
DESCRIPTION OF BOUNDARIES OF NETHERTON DRAINAGE DISTRICT.
ALL that land in the Auckland Land District bounded as follows: Commencing at a point on the left bank of the Waihou River in line with the northern boundary of Lot 3 on a plan deposited in the Land Registry Office at Auckland under No. 8682; thence by the left bank of the Waihou River to its junction with the left bank of the Ngahina Canal; thence by the left bank of the said canal and again by the left bank of the Waihou River to its intersection by the southern boundary of Waihou West No. 4B East Block; thence by the generally southern boundary of that block and Waihou West No. 4B West Nos. 1 and 2 Blocks, the western boundaries of Waihou West No. 4B West No. 2, 4D Section 1, 4E North No. 1, and 4A Blocks, to the northern-most corner of Waihou West No. 4A Block; thence by the southern boundary of Section 7, Block XV, Waihou Survey District, and the southern and south-western boundaries of Section 3, Block XV aforesaid ; thence in a northerly direction following a right line through Section 1, Block XV, Waihou Survey District, to a point on the northern boundary of the said section, 20 chains distant from the north-western corner of Section 1 aforesaid; thence across a road and in an easterly direction along the southern boundary of Section 33, Block XI, Waihou Survey District, to the south-eastern corner of Section 33 aforesaid; thence in a north-westerly direction along the north-eastern boundary of Section 33, Block XI, Waihou Survey District, to a point 35 chains distant from the south-eastern corner of that section; thence in a north-easterly direction by a right line, making an angle of 90 degrees with the eastern boundary of Section 33, Block XI, Waihou Survey District, for a distance of 8 chains; thence in a north-westerly direction by a right line parallel to the eastern boundary of Section 24, Block XI, Waihou Survey District, for a distance of 30 chains; thence in a south-westerly direction by a right line, making an angle of 90 degrees with the western boundary of Section 24, Block XI, Waihou Survey District, for a distance of 8 chains to the south-western boundary of Section 24, Block XI, Waihou Survey District; thence along the south-western boundary of Section 24 aforesaid to the north-western corner of that section; thence in a south-westerly direction following the road on the north-western boundary of Section 31, Block XI, Waihou Survey District, to a point opposite the south-western boundary of Section 27, Block XI, Waihou Survey District; thence in a north-westerly direction across a road and following the south-western boundary of Section 27, Block XI, Waihou Survey District, to a point midway along that boundary; thence in a north-easterly direction by a right line to a point midway along the north-eastern boundary of Section 26, Block XI, Waihou Survey District; thence in a north-westerly direction following the north-eastern boundary of Section 26, Block XI, Waihou Survey District, to the north-eastern corner of that section; thence in a north-easterly direction along the north-western boundary of Section 25, Block XI, Waihou Survey District, to the north-eastern corner of that section; thence in a westerly direction along the southern boundaries of Sections S9, E10, and W10, Block XI, Waihou Survey District, to the south-western corner of the said Section W10; thence in a northerly direction along the western boundary of Section W10 aforesaid, across a road, and by the western boundaries of west portion of Lot 5, Tahanui Block, and the north-western boundary of Lot 4 on a plan deposited in the Land Registry Office at Auckland under number 5103 to a point in line with the south-western boundary of Lot 2 on the aforesaid plan; thence across a road, and by the south-western boundary of Lot 2 aforesaid; thence by the northern boundary of that lot to its intersection by the western boundary of Te Arawhakapekapeka No. 1 Block; thence by the western boundaries of Te Arawhakapekapeka Nos. 1 and 2A Blocks; the northern boundary of Te Arawhakapekapeka 2A Block to its intersection by the western boundary of Lot 3 on a plan deposited as aforesaid under number 8682; thence by the western and northern boundaries of that lot, across a public road, and by the production of the northern boundary of Lot 3 aforesaid to the point of commencement.
