FIRST SCHEDULE.

ALL that portion of foreshore fronting the boundaries of the Waimairi County commencing at the northern boundary of Reserve 1617, Block 4, Christchurch Survey District, and extending generally southwards to the southern boundary of R.S. 33047, Block 8, Christchurch Survey District; As the said area is more particularly shown and delineated, coloured green, on plan marked M.D. 5649, and deposited in the office of the Marine Department at Wellington.

SECOND SCHEDULE.

(1) IN these conditions the term “Minister” means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.

(2) In these conditions the term “foreshore” means all land between high-water mark of ordinary spring tides and low-water mark of ordinary spring tides.

(3) The concessions and privileges conferred by this Order in Council shall extend and apply only to those parts of the foreshore as shown in green on plan marked M.D. 5649, and deposited in the office of the Marine Department at Wellington.

(4) His Majesty or the Governor-General, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress out and over the said foreshore without payment.

(5) Nothing herein contained shall authorize the Council to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act, 1923, or its amendments, or any regulations made thereunder, and that are or may hereafter be in force.

(6) The Council may enclose any part or parts of the foreshore described in the First Schedule hereto for the purpose of holding athletic sports or games, and may by by-law fix a charge for admission to such enclosed part or parts: Provided that the total number of days on which such enclosures are made shall not exceed six in any one year.

(7) The Council may, subject to the provisions of section 171 of the Harbours Act, 1923, erect or license or permit the erection of bathing-sheds or boat-sheds on the foreshore described in the First Schedule hereto, and may make by-laws regulating the use thereof, and may fix charges for such use: Provided that the funds so received shall be expended in improving the foreshore for the benefit of the public.

(8) Nothing herein contained shall authorize the Council to remove or cause to be removed any stone, sand, shingle, or shells without the consent of the Minister being first obtained.

(9) By-laws made by the Council under the said Act in respect of the foreshore shall not have effect, unless and until approved in writing by the Minister.

(10) The rights, powers, and privileges conferred by or under this Order in Council shall continue to be in force for twenty-one years from the date hereof, unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority.

(11) The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Council six calendar months’ previous notice in writing. Any such notice shall be sufficient if given by the Minister, and delivered at or posted to the last-known address of the Council in New Zealand.

Appointing a Member of the Oamaru Harbour Board.

CHARLES FERGUSSON, Governor-General.

WHEREAS it is provided by subsection three of section thirty-eight of the Harbours Act, 1923, that in the event of an extraordinary vacancy in the office of a non-elective member of a Harbour Board, the Governor-General shall, by Warrant under his hand, appoint some qualified person in his place:

And whereas Adam Mackay, a non-elective member of the Oamaru Harbour Board, has resigned his office, and an extraordinary vacancy in the membership of the Board has been created, and it is desirable to appoint a qualified person in his place:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the herein-before-recited power and authority, doth hereby appoint

Charles Jeremiah Marshall,

to be a member of the Oamaru Harbour Board, in the place of the said Adam Mackay, resigned.

As witness the hand of His Excellency the Governor-General, this 25th day of May, 1928.

Appointment of Cemetery Trustees revoked.—(H. 2/87.)

IN pursuance and exercise of the powers and authorities vested in me by the Cemeteries Act, 1908, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, do hereby revoke a certain Warrant dated the twenty-second day of October, one thousand eight hundred and eighty-four, and published in the Gazette on the thirtieth day of the same month, appointing trustees for the Goldsborough Public Cemetery, as described in the Schedule hereto.

SCHEDULE.

GOLDSBOROUGH PUBLIC CEMETERY.

RESERVE 137, Block XV, Waimea Survey District: Area, 3 acres, more or less.

As witness the hand of His Excellency the Governor-General, this 22nd day of May, 1928.

Member of Island Council of Penrhyn, under the Cook Islands Act, 1915, appointed.

PURSUANT to the authority vested in me by section sixty-five of the Cook Islands Act, 1915, and by an Order in Council of the twenty-first day of March, one thousand nine hundred and sixteen, establishing (inter alia) an Island Council for the Island of Penrhyn, in the Cook Islands, and determining the constitution thereof, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, do hereby nominate and appoint

Tuatini Paitiki, of Tetautua

to be a member of the said Island Council of Penrhyn in place of Hiro Hapai (a patient at the Makogai Leper Station), to hold office during my pleasure as from the date hereof.

As witness the hand of His Excellency the Governor-General of the Dominion of New Zealand, this 24th day of May, 1928.

Changing the Purpose of a Reserve in the Town of Ross, Westland Land District.

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for a telegraph station or other purposes of the General Government, being a purpose within Class II of the Second Schedule of the Public Reserves and Domains Act, 1908:

And whereas it is expedient that such land should be appropriated for recreation purposes, being a purpose within Class III of the said Second Schedule:

Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in exercise of the powers and authorities conferred upon me by the eleventh section of the Public Reserves and Domains Act, 1908, do by this notification declare that the said land shall, from and after the first day of June, one thousand nine hundred and twenty-eight, be appropriated for recreation purposes under Class III of the Public Reserves and Domains Act, 1908; and I do hereby direct that this notification shall be published in the New Zealand Gazette.

WESTLAND LAND DISTRICT.

Lot Number 96, Town of Ross: Area, 1 rood 10 perches.
