conditions as in its discretion it thinks expedient or desirable.
26. In particular the Board may, for the purposes of the said section—
(a) Undertake the publication of any matter, document, or record:
(b) Enter into contracts with the Government or any person with regard to payment of the cost of any printing, drawing, sketches, copyright, royalties, or other charges:
(c) Purchase books, periodicals, manuscripts, drawings, photographs, or articles:
(d) Make payment of subsidies or assistance to any publication, society, or person which, in the opinion of the Board, will tend to assist and promote the purposes of the said section:
(e) Make payments of subscriptions to kindred Boards or societies in any part of the world, or of any fees that may be necessary to obtain registration or recognition by any such Board or society.
27. The Board may organize or assist in equipping and paying the expenses of any expedition to any part of New Zealand or to any island in the Pacific Ocean for the investigation and the collection of records regarding any matter or thing which comes within the objects or purposes defined by the said section.

Regulations as to Constitution of the Maori Purposes Fund Control Board and Matters relevant thereto.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of May, 1928.

Present:

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by section three of the Native Land Amendment and Native Land Claims Adjustment Act, 1924, and of all other powers him enabling, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the regulations with respect to the Maori Purposes Fund Control Board made on the eighth day of December, one thousand nine hundred and twenty-four, and published in the New Zealand Gazette on the eleventh day of December, one thousand nine hundred and twenty-four, and doth hereby make the following regulations with respect to the Maori Purposes Fund Control Board and otherwise for the purpose of giving effect to the said section three.

REGULATIONS.

  1. In these regulations—
    “Board” means the Maori Purposes Fund Control Board:
    “Fund” means the Maori Purposes Fund:
    “Chairman” and “Deputy Chairman” mean respectively the Chairman and Deputy Chairman of the Board:
    “Member” means a member of the Board:
    “The said section” means section 3 of the Native Land Amendment and Native Land Claims Adjustment Act, 1924:
    “Native” includes the descendants of Natives.

MEMBERS.

  1. The Board shall consist of the following members:—
    (a) The Native Minister, who shall be Chairman:
    (b) The Under-Secretary of Native Affairs, who shall be Deputy Chairman:
    (c) The Director of Education:
    (d) The members of the House of Representatives for the time being representing the Maori race:
    (e) Such other person as may from time to time be appointed in that behalf by the Native Minister.

  2. Subject to the provisions of these regulations as to death, resignation or removal from office, a member appointed by the Native Minister shall hold office for a period of two years, but a retiring member may be reappointed: Provided, however, that the members appointed by the Native Minister holding office at the date of the making of these regulations shall continue to hold office under these regulations, and shall be and be deemed to have been appointed under these regulations for a period of one year only from such date.

  3. For any cause which may seem to him sufficient, the Native Minister may at any time, by writing under his hand, remove from office any member appointed under paragraph (e) of clause 2. Any vacancy caused by the death, resignation, or removal of any such member may be filled by the Native Minister.

  4. The powers of the Board shall not be affected by any vacancy in the membership thereof.

MEETINGS.

  1. The Board shall meet for the despatch of business at such times and places as the Board, the Chairman, or Deputy Chairman may from time to time direct.
  2. Once at least in every year a meeting (hereinafter called “the annual meeting”) shall be held at Wellington. The time and place for such meeting shall be fixed by the Chairman, and shall be held (if possible) during a parliamentary session.
  3. At every meeting the Chairman, or in his absence the Deputy Chairman, shall preside. If neither of these members is present, then some member chosen by the members present shall preside.
  4. A quorum at any meeting of the Board shall consist of three members, and no business beyond adjournment of the meeting shall be transacted unless a quorum is then present.
  5. The Board shall decide all questions before it by a majority of votes. In case of an equality of votes the Chairman or other member presiding shall have a casting-vote as well as a deliberative vote.
  6. Subject to the said section and to these regulations, the Board may regulate its own proceedings.
  7. All proceedings and resolutions of the Board shall be recorded in a minute-book to be kept for the purpose by the Secretary of the Board.

ADVISORY COMMITTEE.

  1. (a) The Board may from time to time appoint one or more advisory committees consisting of such persons as the Board thinks fit, and may define the powers and functions of any such committee and regulate its procedure.
    (b) The Board may provide any such committee with such clerical and other professional assistance as may be reasonably required, and may pay out of the fund any proper expenditure in connection with such committee or the meetings thereof.

SEAL.

  1. The seal of the Board shall be such as is determined by the Native Minister, and shall be kept in the custody of the Secretary or such other person as the Board may appoint for the purpose.
  2. The seal of the Board shall not be affixed to any document except in the presence either of the Secretary or other responsible officer of the Board and one member, or in the presence of two members, who shall attest the sealing of the document.

ACCOUNTS.

  1. All moneys received by the Board shall be forthwith paid into the Native Trustee’s Account to the credit of the fund.
  2. All payments requiring to be made out of the fund shall be paid on the certificate of the Secretary or other responsible officer that the claim is in order, countersigned by the Chairman or Deputy Chairman, or upon requisition under seal of the Board.
  3. Proper books of account and other books shall be kept by the Native Trustee, in which shall be entered correct records of all moneys received and paid out of the fund. Such books shall be open at all reasonable times to inspection by members of the Board or by any authorized officer of the Board.
  4. The Native Trustee may from time to time deduct from the moneys held in the fund a fair and reasonable sum as shall be determined by the Native Minister for the cost of the administration of the fund.
  5. At the close of each financial year, ending on the 31st day of March, the Native Trustee shall cause to be prepared statements showing the total receipts and payments and income and expenditure of the Board during that year, together with a balance-sheet showing the Board’s assets and liabilities, which shall be audited by the Audit Office.
  6. Copies of the statements and balance-sheet referred to in the last preceding clause shall be sent by the Native Trustee to the Secretary of the Board, who shall place them before the Board at the annual meeting. The Secretary shall prepare and submit to the Board at such meeting a report of the operations and commitments of the Board during the same period, together with an estimate of the probable financial requirements of the Board for the next financial year.
