Consenting to the Raising of a Loan by the Wairarapa South County Council.

At the Government Buildings at Wellington, this 24th day of March, 1928.
Present:
THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.
WHEREAS the Wairarapa South County Council has obtained, in terms of section fourteen of the Local Government Loans Board Act, 1926, exemption from the requirements of that Act in respect of a sum of one thousand pounds:
And whereas application has been made under section twenty, subsection one, of the Finance Act, 1919, for the precedent consent of the Governor-General in Council to enable the said local authority to borrow the said sum of one thousand pounds to be known as the Flood Damage Loan (General), one thousand nine hundred and twenty-six:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing of the sum of one thousand pounds by the Wairarapa South County Council, and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Finance Act, 1919, and shall operate accordingly as a consent of the Governor-General in Council to the raising of the said sum.

Consenting under the Local Government Loans Board Act, 1926, to the Raising of a Loan by the Invercargill Fire Board.

IN pursuance and exercise of the powers and authorities conferred upon him by the Local Government Loans Act, 1926, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing by the Invercargill Fire Board of the sum of two thousand four hundred pounds for the purpose of purchasing a motor fire engine and escape, subject to the following conditions:-

  1. That the term for which the loan is borrowed shall not exceed eight years.
  2. That the rate of interest payable in respect of the said loan shall not exceed six pounds per centum per annum.
  3. That the local authority shall, before borrowing the said sum or any part thereof, make provision for the repayment thereof by establishing a sinking fund of not less than four pounds twelve shillings and sixpence per centum per annum, calculated on the amount raised.
  4. That no portion of interest or sinking fund shall be paid out of loan-money.

    At the Government Buildings at Wellington, this 24th day of March, 1928.

    IN pursuance and exercise of the powers and authorities conferred upon him by the Local Government Loans Board Act, 1926, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with
    the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing by the Devonport Borough Council of the sum of eleven thousand one hundred and ten pounds for the relief of unemployment, subject to the following conditions:-
  5. The sum may be borrowed for a term not exceeding twenty-five years.
  6. The Devonport Borough Council shall, before borrowing the said sum or any part thereof, make provision for the repayment of the said sum by establishing a sinking fund under the Local Bodies' Loans Act, 1926, and by making to such sinking fund payments at intervals of not more than one year, at a rate which shall be not less than two per centum, such payments to be made in respect of every part of the said sum for the time being so borrowed and not repaid, and the first payment to be made not later than one year after the first day from which interest to the lender is computed on any moneys so borrowed.
  7. That no portion of the interest or sinking fund shall be paid out of the loan-moneys.

    Prescribing the Rate of Interest that may be paid by the Lower Hutt Borough Council in respect of a Loan of £9,000, authorized to be raised for the Purpose of widening and constructing certain Streets.

    ORDER IN COUNCIL.
    At the Government Buildings at Wellington, this 24th day of March, 1928.
    Present:
    THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.
    WHEREAS by section one hundred and fourteen of the Local Bodies' Loans Act, 1926, it is provided that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money or any part thereof has not been borrowed, the local authority or public body may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term, as may be prescribed by the Governor-General by Order in Council:
    And whereas the Lower Hutt Borough Council has been authorized to borrow the sum of nine thousand pounds for the purpose of widening and constructing certain streets:
    And whereas the Minister of Finance has given his precedent consent as required by the above-recited section one hundred and fourteen, and it is desired that the rate of interest at which the money may be borrowed be not exceeding six per centum per annum:
    Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the rate of interest that may be paid by the Lower Hutt Borough Council in respect of the said sum of nine thousand pounds shall be a rate not exceeding six per centum per annum, and the said Lower Hutt Borough Council is hereby authorized to borrow the said sum of nine thousand pounds accordingly.

    Prescribing the Term for which the Ohura County Council may borrow the Sum of £2,500, being a further Portion of a Loan of £22,700, authorized to be raised for widening, culverting, and metalling Roads in the Otangiwai No. 2 Special-rating Area, and also the Rate of Interest payable thereon.
