Directing Sale of Railway Land under the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 6th day of December, 1927.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by the thirtieth section of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work, the Governor-General may, by an Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and direct the sale of the land described in the Schedule hereto.

SCHEDULE.

APPROXIMATE area of the piece of land : 6·72 perches.

Portion of railway reserve (Part Section 21, right bank Wanganui River), Block III, Westmere Survey District, City of Wanganui. (S.O. 2262.)

In the Wellington Land District, as the same is more particularly delineated on the plan marked W.R. 39489, deposited in the office of the Minister of Railways, at Wellington, and thereon bordered red.

The Western Side of Portion of Sydenham Street, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 13th day of January, 1928.

Present:

THE HONOURABLE W. DOWNIE STEWART PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the third day of February, one thousand nine hundred and twenty-seven, the portion of street affected by such resolution being more particularly described in the Schedule hereto, viz:—

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the western side of that portion of Sydenham Street, beginning at a point approximately 683·34 links from its junction with Lambeth Road, and extending for a distance of approximately 100 links, being the part of road fronting Lot 69, Deeds Plan 108, Township of Creswick, being part Section 31, Karori Registration District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Sydenham Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Sydenham Street, fronting Lot 69, Deeds Plan 108, Township of Creswick, being part Section 31, Karori R.D. As the said portion of street is more particularly delineated on the plan marked P.W.D. 69043, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Land District, and thereon coloured red.

The Southern Side of Portion of Somersal Road, in the Rangitikei County, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution, passed by the Rangitikei County Council on the fourth day of August, one thousand nine hundred and twenty-seven, the portion of road affected by such resolution being more particularly described in the Schedule hereto, viz. :—

“That the Rangitikei County Council agrees to exempt from the provisions of section one hundred and seventeen of the Public Works Act, 1908, the southern side of the Somersal Road from its junction with the Upper Tutaenui Road as far as the said road bounds Section X, Block XV, Wangaehu Survey District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Somersal Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE southern side of all that portion of road situated in the Wellington Land District, County of Rangitikei, known as Somersal Road, adjoining parts Section 10, Block XV, Wangaehu Survey District. As the same is more particularly delineated on the plan marked P.W.D. 70622, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Land District, and thereon coloured blue.

WHEREAS it is provided by section twenty of the Orchard and Garden Diseases Act, 1908 (hereinafter termed “the said Act”), as amended by section four of the Orchard and Garden Diseases Amendment Act, 1914, that the Governor-General may from time to time, by Order in Council gazetted, make regulations, inter alia, for the registration of orchards, and the terms and conditions of such registration :

And whereas it is expedient to revoke the regulations as to the registration of orchards, made by Order in Council
