The North-eastern Side of Portion of Trent Street, in the City
of Wellington, exempted from the Provisions of Section 117
of the Public Works Act, 1908, subject to a condition as to
the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of
November, 1927.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1908, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the
said Dominion, doth hereby approve of the following resolution
passed by the Wellington City Council on the twenty-ninth
day of September, one thousand nine hundred and twenty-
seven, the portion of street affected by such resolution being
more particularly described in the Schedule hereto, viz. :—

“The Wellington City Council, being the local authority
having control of the streets in the City of Wellington,
hereby declares that the provisions of section one hundred
and seventeen of the Public Works Act, 1908, shall not
apply to the north-eastern side of that portion of Trent
Street beginning at a point approximately 250 links from
its junction with The Parade, and extending for a distance
of 100 links, being the portion of Trent Street fronting
Lot 427, Township of Island Bay, as more particularly
delineated in deeds title, Vol. 115, folio 2, in office of
District Land Registrar, Wellington ” ;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
eastern side of the portion of Trent Street (described in the
Schedule hereto), within a distance of thirty-three feet from
the centre-line of the said portion of street.

SCHEDULE.

THE north-eastern side of all that portion of street situated
in the Wellington Land District, City of Wellington, known
as Trent Street, adjoining Lot 427, deeds plan 127, of Section 8,
Town R.D., Block XIII, Port Nicholson Survey District.
As the same is more particularly delineated on the plan
marked P.W.D. 70343, deposited in the office of the Minister
of Public Works, at Wellington, in the Wellington Land
District, and thereon coloured red.

of New Plymouth, exempted from the Provisions of Section 117
of the Public Works Act, 1908, subject to a Condition as to
the Building-line.

ninth day of August, one thousand nine hundred and twenty-
seven, the portion of street affected by such resolution being
more particularly described in the Schedule hereto, viz. :—

“That the New Plymouth Borough Council, being the
local authority having control of the street hereinafter
mentioned, hereby resolves and declares that the pro-
visions of section one hundred and seventeen, subsection
one, of the Public Works Act, 1908, shall not apply to that
portion of the eastern side of Baring Terrace to which
Lots 1, 2, 3, and 4 of part Town Belt H, New Plymouth,
have frontages ” ;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the eastern
side of the portion of Baring Terrace (described in the
Schedule hereto), within a distance of thirty-three feet from
the centre-line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street, situated in the
Taranaki Land District, Borough of New Plymouth, known
as Baring Terrace, fronting part Town Belt H, Town of New
Plymouth. As the said portion of street is more particularly
delineated on the plan marked P.W.D. 70230, deposited in
the office of the Minister of Public Works, at Wellington,
in the Wellington Land District, and thereon coloured red.

and seventeen of the Public Works Act, 1908, shall not
apply to the north-eastern side of that portion of Chaytor
Street, beginning at its junction with Old Karori Road
and extending for a distance of 322·96 links, being the part
of road fronting Lots 2, 3, and 4, D.P. 7816, part Section 32,
Karori Registration District, Block VI, Port Nicholson
Survey District ” ;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
eastern side of the portion of Chaytor Street (described in the
Schedule hereto), within a distance of thirty-three feet from
the centre-line of the said portion of street.

part Section 32, Karori R.D., Block VI, Port Nicholson
Survey District. As the said portion of street is more par-
ticularly delineated on the plan marked P.W.D. 70166,
deposited in the office of the Minister of Public Works, at
Wellington, in the Wellington Land District, and thereon
coloured red.

WHEREAS by section one hundred and fourteen of the
Local Bodies’ Loans Act, 1926, it is provided that,
notwithstanding anything to the contrary in any Act or
in any rule of law, where a local authority or public body has
been authorized before the passing of the said Act, or is
thereafter authorized, to borrow money, whether pursuant to
a poll of ratepayers or otherwise howsoever, whether the rate
of interest or the term of years of the loan was or was not
specified or determined, and such money, or any part thereof,
