  1. No license shall be capable of being assigned or transferred, and any agreement for the assignment or transfer of a license shall be void as such, and shall operate as a surrender of the license to the Crown : Provided, however, that in any case where the licensee has effected improvements on the land comprised in his license to the extent prescribed with respect to the period of two years after the date of selection, or where by reason of special and unforeseen circumstances an assignment or other disposition is, in the opinion of the Board and the Minister, desirable, such disposition may be permitted.

  2. Every licensee shall, for a period of four years from the date of his license, be exempt in respect of the land comprised in his license, from all general rates made and levied by any local authority.

Improvements.

  1. Within two years after the date of selection the licensee shall clear and bring under cultivation not less than one-tenth of the total area of his selection; and, in addition thereto, shall place upon the land substantial improvements of a permanent character to a value equal to not less than ten shillings per acre.

Within four years after the date of selection the licensee shall clear and bring under cultivation an additional area of not less than one-third of the total area of his selection; and, in addition thereto, shall place upon the land substantial improvements of a permanent character to an additional value of not less than ten shillings per acre.

Within six years after the date of selection the licensee shall have laid down in permanent cultivated grasses and clovers not less than one-half of the total area of the section, and have placed upon the land substantial improvements of a permanent character to a total value of not less than thirty shillings per acre.

Before any improvements are effected upon any of the land disposed of under these regulations, a proposal setting out the improvements in detail shall be submitted for the approval of the Land Board.

All areas brought into cultivation and all improvements placed upon the land, shall be maintained in good order and condition during the currency of the license. All areas brought under pasture shall be so maintained by the necessary application of manures : Provided that if the licensee resides on the land comprised in his license, he shall be deemed to have complied with the conditions herein set out as to improvements if within the times prescribed by the regulations in that behalf he puts on the land improvements to a value not less than half of the prescribed value.

  1. At any time after completion of improvements to the value prescribed in respect of the period of six years after the date of selection, a licensee who has complied to the satisfaction of the Board with all the conditions of his license shall be entitled, without payment, other than the necessary Crown-grant fee, to become the owner in fee-simple of the land comprised therein.

Forfeiture and Surrender.

  1. If any licensee under these regulations shall fail from time to time to effect the prescribed improvements, or in any other manner shall commit any breach of any conditions to which his license is subject, whether express or implied, his interest therein shall be liable to be absolutely forfeited, and the land shall revert to His Majesty the King.

Any licensee may, with the consent of the Minister, on the recommendation of the Land Board, surrender his interest in his license.

Small Grazing-run. in Hawke's Bay Land District for Lease.

N OTICE is hereby given that the undermentioned small grazing-run is open for selection in terms of the Land Act, 1924; and applications will be received at the District Lands and Survey Office, Napier, up to 4 o'clock p.m. on Tuesday, 7th June, 1927.

Applicants must appear personally before the Land Board for examination at the District Lands and Survey Office, Napier, on Thursday, 9th June, 1927, at 10 o'clock a.m.; but if any applicant so desires he may be examined by the Land Board of any other district.

Preference at the ballot will be given to landless applicants who have one or more children dependent on them, to landless applicants who within two years immediately preceding date of ballot have applied for land at least twice unsuccessfully, to applicants who have served beyond New Zealand as members of the Expeditionary Force ; to persons engaged on military service beyond New Zealand in connection with the late war, if such persons immediately prior to the war were bona fide residents of New Zealand; and to applicants who, while domiciled in New Zealand have served beyond New Zealand, as members of any of His Majesty's Forces in connection with any war other than the war with Germany.

The ballot will be held at the District Lands and Survey Office, Napier, at the conclusion of the examination of applicants.

SCHEDULE.

HAWE'S BAY LAND DISTRICT.-NATIONAL ENDOWMENT.-THIRD-CLASS LAND.

Patangata County.-Mangatoro Survey District.

SECTION 5, Block XV: Area, 1,083 acres 1 rood 26 perches. Capital value, £2,890. Half-yearly rent, £57 16s.

Weighted with the following improvements, which have to be paid for in cash : 5 miles 72 chains boundary and subdivisional fencing, £322; 953 acres bush felled, £2,383 : Total, £2,705.

Situate fifteen miles from Porangahau. Originally covered with beech forest, which has been felled twenty years, except about 80 acres. Logs and stumps of the most durable timber still remain, and it should yet be possible to obtain a quantity of good fencing posts from this material. About 200 acres of excellent native pasture. Hilly country rising to an altitude of 1,545 ft., broken with fairly deep gullies. Papa formation, weathering to a clay subsoil. The run is ring-fenced. An excellent homestead-site, amply provided with good water is to be found at the end of Te Tohe Road; about 25 acres of ploughable land at this point at present covered with manuka. The country is well watered with permanent streams.

ABSTRACT OF CONDITIONS OF LEASE.

Small Grazing-run.

  1. Applicants to be seventeen years of age and upwards.

  2. Term of lease: twenty-one years, with right of renewal, or in the event of subdivision into allotments, right to a lease of one allotment, compensation for loss of right to new lease of other allotments, and valuation of improvements.

  3. Rent commences from the date of lease, and is payable half-yearly, in advance, on 1st March and 1st September in each year.

  4. Applicants to furnish statutory declaration with applications, and, on being declared successful, deposit £1 ls. (lease fee), and a half-year's rent. Rent for the broken period between date of lease and 1st March or 1st September following is also payable.

  5. No person may hold more than one run, except on the recommendation of the Land Board, and with the approval of the Minister of Lands.

  6. Improvements.--Lessee is required to improve the run within one year to the value of one year's rental; within two years to the value of two years' rental, and within six years to the value of four years' rental. In addition to the foregoing, on bush land, improvements are also to be effected within six years to the value of 10s. per acre for every acre of first-class land, and 5s. per acre for every acre of second-class land. Any money paid as valuation for improvements will be allowed as substantial improvements upon the land.

  7. On expiry of term of lease, lessee's improvements will be valued and protected.

  8. Residence must commence within three years in the case of bush land or swamp land, and within one year in the case of open or partly open land, and be continuous until the expiration of the lease. Under certain conditions personal residence may be dispensed with after ten years.

  9. Roads may be taken without payment of compensation.

  10. Lease is liable to forfeiture if conditions are violated.

The sections may be purchased for cash; for cash by instalments; or on special deferred payments under the provisions of the Hutt Valley Lands Settlement Act, 1925, and the Land for Settlements Act, 1925.
