The Eastern Side of Portion of Victoria Crescent, in the City of Nelson, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 4th day of April, 1927.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the twenty-third day of December, one thousand nine hundred and twenty-six, viz:—

“That the Nelson City Council, being the local authority having control of the street in the City of Nelson known as Victoria Crescent, hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the eastern side of the said street fronting Lot 1 and Lot 2 parts of Section 1181 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Victoria Crescent (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street; such condition being of the same effect as By-law No. 229 of the City of Nelson By-law No. 1 (1916), Part VII, relating to building-line.

The North-eastern Side of Portion of Princes Street and the North-western Side of Portion of Main Road, in the Borough of West Harbour, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to Conditions as to the Building-lines.

At the Government House at Wellington, this 4th day of April, 1927.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the West Harbour Borough Council on the ninth day of November, one thousand nine hundred and twenty-six, viz.:—

“The West Harbour Borough Council, being the local authority having control of the hereinafter-mentioned street, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to Main Road and Princes Street in the Township of Hastings as shown on plan produced. The portion of Main Road and Princes Street to be exempted will be that portion adjoining all that parcel of land situated in the Township of Hastings containing by admeasurement three roods and thirty-five and eight-tenths poles, more or less, being allotments numbered respectively one, three, five on the plan of the Township of Hastings, deposited in the Deeds Registry Office at Dunedin ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Princes Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street, and the north-western side of the portion of Main Road (described in the Schedule hereto) within a distance of sixty-six feet from the south-eastern boundary of the said portion of street.

SCHEDULE.

THE north-eastern side of all that portion of Princes Street adjoining Lots 1, 3, and 5, Block I, Township of Hastings, and the north-western side of all that portion of street known as Main Road, adjoining Lot 1, Block I, Township of Hastings ; all in the Otago Land District, Borough of West Harbour. As the said portions of streets are more particularly delineated on the plan marked P.W.D. 67856, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon edged red.

“That the Nelson City Council, being the local authority having the control of the streets in the City of Nelson known as Murphy, Emano, and Tukuka Streets respectively, hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the south-east side of Emano Street fronting Sections E 14, E 17, and E 10, the north-east side of Tukuka Street fronting Sections E 7 and E 10, and the west side of Murphy Street fronting Sections E 7, E 13, and E 14 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Emano Street or the western side of the portion of Murphy Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portions of streets, such condition being of the same effect as By-law No. 229 of the City of Nelson, By-law No. 1 (1916), Part VII, relating to building-line.

SCHEDULE.
