ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 8th day of November, 1926.

Present:

THE HONOURABLE W. DOWNIE STEWART PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by section forty of the Public Reserves and Domains Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint George Henderson, Edward James Kingan, James Smith, Charles Templeton, Peter Vlietstra, and William John Willson

to be the Luggage Domain Board, having control of the land described in the Schedule hereto ; and doth hereby appoint Saturday, the fourth day of December, one thousand nine hundred and twenty-six, at half-past seven o'clock p.m., as the time when, and the Albion Hall, Luggage, as the place where, the first meeting of the Board shall be held.

Municipal Corporations Act, 1920.-Authorizing Investment of Reserve Funds in Bonds, Debentures, or other Securities of certain Local Authorities.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 8th day of November, 1926.

WHEREAS by section one hundred and twenty-three of the Municipal Corporations Act, 1920 (hereinafter referred to as “the said Act”), it is enacted that a Borough Council may invest any part of a reserve fund established by that Council under the said section in respect of any trading undertaking in such securities other than those mentioned in the said section as may be authorized by the Governor-General in Council :

And whereas by Order in Council dated the ninth day of August, one thousand nine hundred and twenty-six, and gazetted on the twelfth day of the same month, a Borough Council was authorized to invest any part of a reserve fund as aforesaid in the bonds, debentures, or other securities of certain local authorities, in advances by way of first mortgage on real securities in New Zealand and in the Common Fund of the Public Trust Office :

And whereas, in addition to the powers contained in the said Order in Council, it is desirable that a Borough Council should be authorized to invest a reserve fund as aforesaid in the bonds, debentures, or other securities of the local authorities hereinafter mentioned :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said section one hundred and twenty-three, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize a Borough Council to invest any part of a reserve fund in the bonds, debentures, or other securities of any Road Board, or Town Board, or Electric-power Board in New Zealand having authority to borrow money.

WHEREAS by section one hundred and seventeen of the Municipal Corporations Act, 1920 (hereinafter referred to as “the said Act”), it is enacted that Renewal Fund Commissioners appointed in pursuance of section one hundred and fifteen of the said Act may invest all moneys received by them for the purpose of a renewal fund in such securities other than those mentioned in the said section as may be authorized by the Governor-General in Council :

And whereas by Orders in Council dated the first day of April and seventh day of July, one thousand nine hundred and twenty-four, and sixth day of April, one thousand nine hundred and twenty-five, and gazetted on the seventeenth day of April, tenth day of July, and ninth day of April, then instant, Renewal Fund Commissioners appointed under section one hundred and fifteen of the said Act were authorized to invest all moneys received by them for the purposes of a renewal fund in the Common Fund of the Public Trust Office, in the bonds, debentures, or other securities of certain local authorities, and in advances by way of first mortgage on real securities in New Zealand :

And whereas in addition to the powers contained in the said Orders in Council it is desirable that Renewal Fund Commissioners should be authorized to invest such funds in the bonds, debentures, or other securities of the local authorities hereinafter mentioned :

Portion of Hampden Road, in the City of Nelson, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 15th day of November, 1926.

Present:

THE HONOURABLE W. NOSWORTHY PRESIDING IN COUNCL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the sixteenth day of July, one thousand nine hundred and twenty-six, viz.—

"That the Nelson City Council, being the local authority having control of the street in the City of Nelson known as Hampden Street, hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the said street fronting Sections 1079A, 1080, 1081, 1084A, 1082, and parts of Sections 1079B, and D 12 " ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portion of Hampden Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street, such condition being of the same effect as By-law No. 229 of the City of Nelson By-law No. l (1916), Part VII, relating to building-line,
