acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the term for which the Central Hawke’s Bay Electric-power Board may borrow the said sum of ten thousand pounds, shall be thirty-six and a half years, and the rate of interest that may be paid thereon shall be a rate not exceeding five and three-quarters per centum per annum, and the said Central Hawke’s Bay Electric-power Board is hereby authorized to borrow the said sum of ten thousand pounds accordingly.

Prescribing the Term for which the Auckland City Council may borrow the Sum of £200,000, being a Further Portion of a Loan of £710,000 authorized to be raised for the Formation and Improvement of various Streets, and for the Provision of Plant, Machinery, and Accessories for such Works, and also the Rate of Interest payable thereon.

WHEREAS by section one hundred and fourteen of the Local Bodies’ Loans Act, 1926, it is provided that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority of public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money or any part thereof has not been borrowed, the local authority or public body may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term, as may be prescribed by the Governor-General by Order in Council:
And whereas the Auckland City Council has been authorized to borrow the sum of seven hundred and ten thousand pounds for the formation and improvement of various streets, and for the provision of plant, machinery, and accessories for such works, and is now desirous of raising the sum of two hundred thousand pounds, being a further portion of the loan of seven hundred and ten thousand pounds:
And whereas the Minister of Finance has given his precedent consent as required by the above-recited section one hundred and fourteen, and it is desired that the term for which the money may be borrowed be thirty-three years, and the rate of interest payable thereon be not exceeding six per centum per annum:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the term for which the Auckland City Council may borrow the said sum of two hundred thousand pounds shall be thirty-three years, and the rate of interest that may be paid thereon shall be a rate not exceeding six per centum per annum, and the said Auckland City Council is hereby authorized to borrow the said sum of two hundred thousand pounds accordingly.

The Eastern Side of Portion of Nelson Street, in the Borough of Petone, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 18th day of October, 1926.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Petone Borough Council on the sixteenth day of August, one thousand nine hundred and twenty-six, viz.:
“That the Petone Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and seventeen, subsection one, of the Public Works Act, 1908, shall not apply to the eastern side of that portion of Nelson Street fronting the land comprised and described in certificate of title, Volume 158, folio 225, Wellington Registry ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Nelson Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE eastern side of all that portion of Nelson Street situated in the Wellington Land District, Borough of Petone, fronting Lot 27 (D.P. 47), part Section 5, Hutt District; as the said portion of street is more particularly delineated on the plan marked P.W.D. 67121, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

The North-western Side of Portion of Scherff Road, in the City of Auckland, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

“That the Auckland City Council, having control of Scherff Road, Auckland, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the portion of Scherff Road fronting Lot 4 of part Lots 85, 86, 87, 88, of Allotment 5, Section 16, Suburbs of Auckland ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Scherff Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE north-western side of all that portion of street, situated in the North Auckland Land District, City of Auckland, known as Scherff Road, fronting Lot 4 on D.P. 17355, being part Allotment 5, Section 16, Suburbs of Auckland. As the said portion of street is more particularly delineated on the plan marked P.W.D. 66543, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.
