“ That the Council of the City of Dunedin hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the north-western side of Neidpath Road in the City of Dunedin where the same abuts on Allotments 277 and 278, Glen Estate ; as the said portion of the said street is more particularly shown by red colour on the plan hereunto annexed ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Neidpath Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE north-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Neidpath Road, abutting on Allotments 277 and 278, Glen Estate. As the said portion of street is more particularly delineated on the plan marked P.W.D. 66809 deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

WHEREAS by an Order in Council dated the first day of February, one thousand nine hundred and twenty-four, and published in the Gazette of the seventh day of that month, the control of the land described in the Schedule to that document, being a reserve for the protection of gannets, was vested in certain persons therein named, who were by the said Order in Council constituted a special Board, by the name of the Cape Kidnapper Bird Sanctuary Board, in pursuance of section two of the Public Reserves and Domains Amendment Act, 1914 :
And whereas it is desirable that William Neilson, of Haumoana, should be appointed a member of the said Board, in place of Cecil Duff, who has resigned :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers conferred on him by section two of the Public Reserves and Domains Amendment Act, 1914, doth hereby appoint the said
William Neilson
to be a member of the Cape Kidnapper Bird Sanctuary Board constituted by the Order in Council dated the first day of February, one thousand nine hundred and twenty-four, hereinbefore referred to, in place of the said Cecil Duff, who has resigned.

Validating Proceedings in connection with Thames Valley Electric-power Board’s Loan of £150,000 for purchasing and constructing Electric Works.

THE HONOURABLE W. DOWNIE STEWART PRESIDING IN COUNCIL.
WHEREAS the Thames Valley Electric-power Board lately proceeded to raise a loan of one hundred and fifty thousand pounds (£150,000) under the Local Bodies’ Loans Act, 1913 (hereinafter referred to as “ the said Act ”), for the purpose of purchasing and constructing electric works :
And whereas the proceedings in connection with the said loan were irregular, in that, contrary to the provisions of subsection two of section ten of the said Act, the poll of ratepayers was taken more than three weeks after the day of the last publication of the notice referred to in section nine of the said Act :
And whereas it appears that the ratepayers of the district have not been misled by such irregularity as aforesaid, and it is expedient to validate the same :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the said poll of ratepayers had been taken within the time prescribed by the said Act, and that the validity of the proceedings in connection with the said loan, or of the security for the said loan, shall not be called in question by reason only of the irregularity aforesaid.

Prescribing the Rate of Interest that may be paid by the Heathcote County Council in respect of a Loan of £1,000 authorized to be raised for the Purpose of providing Relief-works for Unemployed.

At the Government Buildings at Wellington, this 8th day of October, 1926.

THE HONOURABLE W. DOWNIE STEWART PRESIDING IN COUNCIL.
WHEREAS by section one hundred and fourteen of the Local Bodies’ Loans Act, 1926, it is provided that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money or any part thereof has not been borrowed, the local authority or public body may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term, as may be prescribed by the Governor-General by Order in Council :
And whereas the Heathcote County Council has been authorized to borrow the sum of one thousand pounds for the purpose of providing relief-works for unemployed :
And whereas the Minister of Finance has given his precedent consent as required by the above-recited section one hundred and fourteen, and it is desired that the rate of interest at which the money may be borrowed be not exceeding six per centum per annum :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the rate of interest that may be paid by the Heathcote County Council in respect of the said sum of one thousand pounds shall be a rate not exceeding six per centum per annum, and the said Heathcote County Council is hereby authorized to borrow the said sum of one thousand pounds accordingly.
