constituted under the provisions of the Electric-power Boards Act, 1918, of electric works the property of the Mayor, Councillors, and Burgesses of the Borough of Kaitangata (hereinafter referred to as “the borough”) referred to in clause one of a certain agreement made between the Borough of the one part and the Board of the other part (a copy of which is deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District) subject to the condition that such purchase be carried out in accordance with the provisions of the said agreement so far as the same relates to the purchase of electric works.

Consenting to the Payment of Revenues of Land to the Committee of Management.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 8th day of October, 1926.

Present:

THE HONOURABLE W. DOWNIE STEWART PRESIDING IN COUNCIL.

WHEREAS by section three hundred and thirty-three of the Native Land Act, 1909, it is enacted, inter alia, that the rent, purchase-money, or other proceeds of any alienation of land made by a body corporate under that part of that Act shall not, except with the consent of the Governor-General in Council, be paid to the committee of management or directly to the incorporated owners, but to the Maori Land Board of the district in which the land or the greater part thereof is situated:

And whereas application has been made by the proprietors of Mangahauini No. 7 and adjoining blocks for the consent of the Governor-General in Council to the payment of the proceeds of an alienation by the said corporate body by way of lease being made to the committee of management of such corporate body: And whereas the Tairawhiti District Maori Land Board, after due inquiry, recommends that the consent of the Governor-General in Council be granted to the payment of the proceeds arising out of the alienation set out in the Schedule hereto to the committee of management of the said corporate body: And whereas it is expedient that such consent should be granted:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section three hundred and thirty-three of the Native Land Act, 1909, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the payment of the proceeds arising out of the alienation set out in the Schedule hereto to the committee of management of the said corporate body.

Directing the Sale of Land in the Town of Naseby under the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 4th day of October, 1926.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was acquired.


SCHEDULE.

APPROXIMATE area of the piece of land directed to be sold:
1 acre 0 roods 14 perches.

Being Section 15, Block III, Town of Naseby (Otago R.D.).

In the Otago Land District; as the same is more particularly delineated on the plan marked P.W.D. 67230, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon edged red.

The South-eastern Side of Portion of Signal Hill Road, in the City of Dunedin, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 8th day of October, 1926.

Present:

THE HONOURABLE W. DOWNIE STEWART PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the tenth day of February, one thousand nine hundred and twenty-six, viz:—

“ That the Council of the City of Dunedin hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to all that portion of the southern side of that street in the City of Dunedin known as Signal Hill Road, where the same abuts on part of Section 49, Block IX, North Harbour and Blueskin District, as the said portion of the said street is more particularly shown by blue colour on the plan hereunto annexed ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Signal Hill Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE.

THE south-eastern side of all that portion of street situated in the Otago Land District; City of Dunedin, known as Signal Hill Road, fronting part Section 49, Block IX, North Harbour and Blueskin District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 66119, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.
