Authorizing the Purchase by the Waitemata Electric-power Board of certain Electric Works the Property of the Devonport Borough Council.

At the Government House at Wellington, this 4th day of October, 1926.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by section seventy-six of the Electric-power Boards Act, 1925, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the purchase by the Waitemata Electric-power Board (hereinafter referred to as “the Board”), duly constituted under the provisions of the Electric-power Boards Act, 1918, of electric works the property of the Mayor, Councillors, and Burgesses of the Borough of Devonport (hereinafter referred to as “the borough”) referred to in clause one of a certain agreement bearing date the fifth day of July, one thousand nine hundred and twenty-six, and made between the borough of the one part and the Board of the other part, subject to the condition that such purchase be carried out in accordance with the provisions of the said agreement, so far as the same relates to the purchase of electric works.

Authorizing the Laying-off of a Street in the City of Wellington of a Width less than 66 ft., but not less than 40 ft.

ORDER IN COUNCIL.

At the Government House at Wellington, this 4th day of October, 1926.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1920, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Wellington City Council to permit the laying-off of the street described in the Schedule hereto of a width less than sixty-six feet, but not less than forty feet, it being inexpedient to lay off such street of a width of sixty-six feet.


SCHEDULE.

THAT unnamed street off Coutts Street, in the Wellington Land District, City of Wellington, containing by admeasurement 1 rood 19·73 perches, more or less, through Part Section 7, Evans Bay R.D., Block VII, Port Nicholson Survey District. As the same is more particularly delineated on the plan marked P.W.D. 67283, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured pink.

Authorizing the Laying-off of a Street in the City of Auckland of a Width less than 66 ft., but not less than 54 ft.

ORDER IN COUNCIL.

At the Government House at Wellington, this 4th day of October, 1926.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1920, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Auckland City Council to permit the laying-off of the street coloured pink on the plan referred to in the Schedule hereto of a width less than sixty-six feet, but not less than fifty-four feet, within the area described in the said Schedule, it being difficult and inexpedient to lay off a street of a width of sixty-six feet within such area.


SCHEDULE.

ALL that area of land in the North Auckland Land District, City of Auckland, containing by admeasurement 15 acres 2 roods 7·5 perches, more or less, being part Allotment 15, Section 9, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 67113, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon edged green.

Licensing the Kaipara Steamship Company (Limited) to use and occupy a Part of the Foreshore and Land below Low-water Mark at Helensville, in Kaipara Harbour, as a Site for a Wharf and Slip.

ORDER IN COUNCIL.

At the Government House at Wellington, this 4th day of October, 1926.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned, the Kaipara Steamship Company, Limited (who with its successors and assigns, is hereinafter referred to as “the company”), has applied to the Governor-General in Council for a license under the Harbours Act, 1923 (hereinafter called “the said Act”), to occupy a part of the foreshore and land below low-water mark at Helensville, in Kaipara Harbour, as a site for a wharf and slip, built in the position and in accordance with plans marked M.D. 1926, 1927, and 1934A, and deposited in the office of the Marine Department at Wellington:

And whereas it has been made to appear to the Governor-General in Council that the work will not be or tend to the injury of navigation, and the said plans have, prior to the making of this Order in Council, been approved by the Governor-General in Council:

And whereas it is desirable that a license should be granted and issued to the company under the said Act for the purpose aforesaid, on the terms and conditions hereinafter expressed:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the company as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the company to use and occupy that part of the foreshore and land below low-water mark on which the said wharf and slip are erected, as shown on plans marked M.D. 1926, 1927, and 1934A, deposited as aforesaid, for the purpose of maintaining the said structures thereon, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.
