Regulations for the Purpose of the Election of Members of the New Zealand Dairy-produce Control Board.—Notice No. Ag. 2593.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 26th day of August, 1926.

His Excellency The Governor-General in Council.
IN pursuance and exercise of the powers conferred on him by the Dairy-produce Export Control Act, 1923, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the Order in Council made on the twenty-fourth day of April, one thousand nine hundred and twenty-five, and gazetted on the thirtieth day of April then instant, making regulations prescribing the manner of taking the votes of producers for the purpose of the election of members of the New Zealand Dairy-produce Control Board, and in lieu thereof doth hereby make the following regulations.
REGULATIONS.

  1. INTERPRETATION.
    (1.) In these regulations, where not inconsistent with the context,—
    “The Board” means the New Zealand Dairy-produce Export Control Board:
    “The principal Act” means the Dairy-produce Export Control Act, 1923:
    “The amending Act” means the Dairy-produce Export Control Amendment Act, 1926:
    “Returning Officer” means the Returning Officer appointed in terms of section 9 of the amending Act:
    “Producers” means persons carrying on business as suppliers of milk or cream to factories manufacturing dairy-produce for export:
    “Export Factory” means any factory manufacturing dairy-produce for export.
    (2.) These regulations may be cited as the Dairy-produce Control Election Regulations, 1926.
  2. LISTS OF SUPPLIERS.
    (1.) The owner of every export factory situated within a ward, the office of a producers’ representative for which becomes vacant pursuant to the principal Act and to section 18 of the Appropriation Act, 1925, on the 31st day of August, 1926, shall within seven days of the publication of these regulations in the Gazette deliver to the Returning Officer a list of the names of all producers carrying on business as suppliers of milk or cream to such export factory.
    (2.) The owner of every export factory situated within a ward, the office of a producers’ representative for which becomes vacant pursuant to the principal Act on the 30th day of June in any succeeding year, shall, within ten days after the 1st day of May in that year, deliver to the Returning Officer a list of the names of all producers carrying on business as suppliers of milk or cream to such export factory on such lst day of May.
    (3.) Every such list shall be verified by the signature of the owner, or one of the owners, of such export factory, or of the manager, secretary, or other responsible official on behalf of such owner or owners.
    (4.) The Returning Officer may, in his discretion, require the accuracy of any such list to be verified by statutory declaration or other satisfactory evidence.
  3. COMPILATION OF ROLLS.
    (1.) The Returning Officer shall prepare from the said lists a roll of producers, by export factories, for every ward for which an election of a producers’ representative is to be held.
    (2.) Every such roll shall contain the surnames of the producers entered therein, together with their first names and addresses so far as known to the Returning Officer, and the names entered shall be numbered consecutively.
    (3.) If the name of any person appears as a producer on lists supplied for more than one export factory, the Returning Officer shall, unless such person exercises the right of election conferred by subsection (4) of section 5 of the amending Act, enter the name of such person in respect of such one of the said export factories as he thinks fit.
    (4.) The Returning Officer may exclude from the roll the name of any person appearing in any of the said lists whom he has reason to believe nevertheless not qualified to vote, and may add to the roll the name of any person not appearing in any of the said lists whom he has reason to believe qualified to vote.
