Authorizing the Newmarket Borough Council to maintain a Monument as a Permanent War Memorial.

At the Government House at Wellington, this 9th day of August, 1926.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the power and authority conferred upon him by section fifteen of the Finance Act, 1919 (hereinafter referred to as “the said section”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the provision and maintenance, by the Newmarket Borough Council, of a monument as a permanent war memorial, as provided by the said section; and, with the like advice and consent, doth hereby approve of the provision of such monument in that portion of Newmarket described in the Schedule hereto.
SCHEDULE.
NEWMARKET WAR MEMORIAL SITE.
ALL that area in the North Auckland Land District, situated in the Borough of Newmarket at the junction of the streets known as Victoria Crescent and Broadway, being part of Borough Reserve No. 32. Bounded on the south-west by other part of No. 32, about 35 links; on the north-west by Victoria Crescent, 20 links; on the north-east by public street; and on the south-east by Broadway, 20 links.

Applying the Provisions of Section 97 of the Native Land Amendment Act, 1913, to a Mortgagee other than a State Loan Department.

At the Government House at Wellington, this 9th day of August, 1926.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS subsection two of section ninety-seven of the Native Land Amendment Act, 1913, enacts that the Governor-General in Council may at any time declare that the provisions of the said section ninety-seven shall apply to the case of a mortgage of a lease in favour of any mortgagee other than a State Loan Department:
And whereas it is expedient that the provisions of the said section should apply to the mortgage herein referred to:
Now, therefore, in pursuance of the said section and of all other powers and authorities me thereunto enabling, I, General
Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby declare that the provisions of the said section ninety-seven shall extend and apply to the case of the mortgage described in the Schedule hereto.
SCHEDULE.
MEMORANDUM of mortgage to the Union Bank of Australia (Limited), formerly registered as No. 67495 in the Auckland Land Registry, but now registered in the Land Registry of Poverty Bay, over two memoranda of lease numbered 4842 and 4843 respectively, granted by the Native owners of the land comprised therein and named Waikura No. 2 Block, containing by admeasurement 9,507 acres, more or less, and being all the land formerly comprised in certificate of title, Volume 209, folio 187, of the Auckland Registry, and now Provisional Register, Volume 37, folio 102, of the Poverty Bay Registry, which said memoranda of lease are dated respectively the 10th and 16th day of December, 1909.

Consenting to Land being taken for the Purposes of a Public School in the Borough of Gisborne.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes of a public school.
