weeds or plants as may be directed by the Commissioner of
Crown Lands.

The lease shall be liable to forfeiture if the lessee fails
to fulfil any of the conditions of the said lease within twenty-one days after the date on which the same ought to have
been fulfilled. -
The leases shall be for the term of the years as specified
above, but shall be subject to termination by twelve months'
notice in the event of the land being required by the Crown.
The reserves are described for the general information of
intending buyers, who are recommended, nevertheless, to
make a personal inspection, as the Department is not responsible for the absolute accuracy of any description.

Timber in the Nelson Land District for Sale by Public Auction.

NOTICE is hereby given that the right to cut and remove
the milling-timber on the undermentioned land will
be offered for sale by public auction in one lot at the District
Lands and Survey Office, Nelson, on Wednesday, 21st July,
1926, at 2.30 o'clock p.m.
SCHEDULE.
NELSON LAND DISTRICT.
Sections 79 and 80, Block XV, Oparara Survey District:
Area, 545 acres. Total estimated quantity of milling-timber,
1,936,400 superficial feet, comprising—
Rimu ... 1,884,200 superficial feet.
Kahikatea ... 34,200 "
Beech ... 18,000 "
Upset price: £1,500.
Time for removal of timber : Five years.
Terms of Payment.
One-fifth of the purchase money and £1 1s. license fee to
be paid on the fall of the hammer, balance of purchase-money
will be secured by four “on demand” promissory notes
made and endorsed to the satisfaction of the Commissioner
of Crown Lands and falling due on 1st July, 1927, 1st July,
1928, 1st July, 1929, and 1st July, 1930, respectively. Each
promissory note shall be of an amount equal to one-fifth of
the purchase-money plus 5 per cent. interest from date of
sale.
Conditions of Sale.

The right to cut and remove the milling-timber will be
sold generally in accordance with the following conditions
and such other conditions as the Commissioner in his discretion considers necessary. -
The provisions contained in the timber regulations
under the Land Act, 1924, shall apply, in so far as they are
applicable to the sale of this timber. -
The quantities of timber set forth in above Schedule
are furnished for the information of intending purchasers,
who are expected, however, to make their own estimate
previous to the sale. No contract for purchase shall be
voidable nor shall the licensee be entitled to any abatement
in price by reason of the said timber being of less quantity,
quality, and kind than as stated herein, nor shall any extra
sum be claimed by the Crown if the quantity of timber is
found to be in excess of that stated herein. -
The promissory notes will be presented at the times
indicated in the terms of payment but they may be presented
for payment at any time, if more than a due proportion of
the timber is found to be cut or should any breach of the
conditions occur, or if in the opinion of the Commissioner
the interest of the Crown is jeopardized. -
The purchaser of the timber shall have no right to the
use of the land. -
The timber shall be cut in a face and the right is reserved
to follow up the mill-workings by felling and grassing such
areas as from time to time are cleared of milling-timber. -
Cutting must commence within six months from date of
sale and shall be continuous during currency of the license. -
The right to lay down and to work tram-lines through
the land by persons other than the licensee is reserved. -
The licensee shall not put, throw, or place, or allow to
be put, thrown, or placed, into any river, stream, or water-
course, or into any place where it may be washed into any
river, stream, or watercourse, any sawdust or other sawmill-
refuse. -
If the timber is unsold at auction the right to cut it
at the upset price will remain open for application until
further notice. -
No compensation will be given nor shall any be claimed
for any error, discrepancy, or misdescription whatever in
respect of the timber or in these conditions. -
All the timber, whether standing, felled, or in logs,
shall remain the property of the Crown until the purchase-
money is paid in full. -
Should any dispute arise as to the boundaries the
decision of the Commissioner shall be final and conclusive.

NOTICE is hereby given that the undermentioned education reserves will be offered for lease by public auction
for a term of twenty-one years, with the perpetual right of
renewal for further successive terms of twenty-one years, at
the District Lands and Survey Office, Napier, on Wednesday,
4th August, 1926, at 10.30 o’clock a.m., under the provisions
of the Education Reserves Act, 1908, and amendments, and
the Public Bodies' Leases Act, 1908

The above sections are situated on the western extremity
of Scinde Island, with access from Havelock Road. The
greater portion of the area is steep slope, but there is sufficient
flat land on each section on which to build. The sections
command an extensive view of the surrounding district, and
should prove desirable residential sites. Within five minutes
of a regular motor-bus service.
ABSTRACT OF TERMS AND CONDITIONS OF LEASE.
-
One half-year’s rent at the rate offered, valuation for
improvements, rent for the broken period, and lease and
registration fees (£2 2s.) must be paid for on the fall of the
hammer. -
Term of lease, twenty-one years from date of sale, with
perpetual right of renewal for successive terms of twenty-one
years. -
Rent of renewal lease to be fixed by arbitration. If
lessee does not desire a new lease at the end of the term, land
to be leased by auction. -
No transfer or sublease allowed without the consent of
the Land Board. -
Lessee to cultivate and improve the land and keep it
clear of weeds; creeks, drains, and watercourses to be kept
open. -
Interest at the rate of 10 per cent. per annum to be paid
on rent in arrears. -
Buildings which may be erected on the land to be kept
in good repair and condition. -
No gravel to be removed from the land without the
consent of the Land Board. -
Lessee will not carry on any offensive trade.

Lessee to give notice to the Land Board before making
improvements. -
Lessee to pay all rates, taxes, and assessments.
-
Lease liable to forfeiture if conditions are violated.
Form of lease may be perused and plans and full particulars
obtained at this office.
