ERRATUM.—In the Warrants of temporary and permanent reservation dated 20th March and 18th May, 1926, respectively, and published in Gazette Nos. 17, of the 25th March, and 34, of the 27th May, 1926, respectively, in the area of Section 1268R, Block VI, Town of Waipahi, for “2 roods 21 perches” read “1 rood 21 perches.”


Certain Lands, in respect of which there are no Electors, included in Borough of Waihi.

A PROCLAMATION.

WHEREAS a petition, publicly notified, has been presented to me under section one hundred and thirty-four of the Municipal Corporations Act, 1920, by the Council of the Borough of Waihi praying me to alter the boundaries of the Borough of Waihi so as to include therein the piece of land described in the Schedule hereto, being land, in respect of which there are no electors, adjacent to the said borough:

Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in pursuance of the powers and authorities vested in me by the said Act, do hereby proclaim and declare that the boundaries of the said borough are hereby altered so as to include within the limits of the said borough the land described in the said Schedule hereto, being land, in respect of which there are no electors, adjacent to the said borough.


SCHEDULE.

ALL that area in the Auckland Land District, being that road known as the Waihi Beach Road, and extending from the Waihi–Tauranga Road to the sea, passing through Block XVI, Ohinemuri Survey District, Block IV, Aroha Survey District, Block I, Katikati North Survey District, and Block III, Waihi North Survey District.

Also all that area known as part Waihi No. 2, Waihi No. 3, and part Waihi No. 5 Blocks, as shown on certificate of title, Volume 386, folio 245, deposited in the office of the District Land Registrar at Auckland.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of the said Dominion, this 29th day of May, 1926.

Apportioning the Cost of Maintenance, &c., of Jones’ Drain and Hamilton-Eureka Drain, in the County of Waikato.

A PROCLAMATION.

WHEREAS under the provisions of section sixty-five of the Land Drainage Act, 1908 (hereinafter referred to as “the said Act”), a Commission was appointed and an inquiry was duly held with a view to determining what local authority could most conveniently and efficiently control the following drains situated in the County of Waikato (and hereinafter together referred to as “the said drains”)—that is to say, the drain known as Jones’ Drain, adjoining Ferriss’ Road, Tauwhare, and its subsidiary drains (hereinafter referred to as “Jones’ Drain”), and the drain running along the main Hamilton–Eureka Road at Eureka in front of the properties of Messrs. Pilkington, McClennan, and others and its subsidiary drains (hereinafter referred to as “the Hamilton-Eureka Drain”)—and what proportion of the cost of maintaining, repairing, improving, or reconstructing the said drains should be paid by any, and, if so, which, local authority or local authorities: And whereas such Commission did report to the Governor-General, after due inquiry, its opinion as to the matters respecting which it was appointed to report: And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby proclaim and direct as follows, that is to say:—

  1. That the said drains shall be under the exclusive care, control, and management of the Eureka Drainage Board (hereinafter referred to as “the Drainage Board”).

  2. I fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said drains shall be provided and paid by the Drainage Board and the Tamahere Road Board (hereinafter referred to as “the Road Board”) as follows:—

(a.) The cost already incurred or which may hereafter be incurred by the Drainage Board in erecting, painting white, and maintaining a wooden rail fence approximately two chains in length between Tauwhare Road and Jones’ Drain at the junction of Ferriss’ Road and Tauwhare Road shall be provided and paid by the Drainage Board and the Road Board in equal proportions.

(b.) The Road Board shall pay to the Drainage Board the sum of twenty-five pounds (£25) towards the cost
