At the Government Buildings at Wellington, this 10th day of February, 1926.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Onehunga Borough Council on the thirty-first day of August, one thousand nine hundred and twenty-five, viz. :

"That the Onehunga Borough Council, having control of the Esplanade Road in the Borough of Onehunga, by resolution hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the street fronting part of Lot 1A of Allotment 1 of Section 33, Town of Onehunga "; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Esplanade Road (described in the Schedule hereto), within a distance of ten feet from the present northern boundary of the said portion of street.


SCHEDULE.

THE northern side of all that portion of street situated in the North Auckland Land District, Borough of Onehunga, known as Esplanade Road, fronting Part Lot 1A of Allotment 1, Section 33, Town of Onehunga. As the said portion of street is more particularly delineated on the plan marked P.W.D. 64158, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.

Validating Proceedings in connection with Waipawa County Council’s Loan of £600 for forming, metalling, and culverting Portion of Rangitoto Road.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of February, 1926.

Present:

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS the Waipawa County Council lately proceeded by way of special order to raise a loan of six hundred pounds (£600) under paragraph (e) of section sixteen of the Local Bodies’ Loans Act, 1913 (hereinafter referred to as “the said Act”), for the purpose of forming, metalling, and culverting a portion of Rangitoto Road :

And whereas the proceedings in connection with the said loan were irregular, in that, although the special roll prepared in accordance with sections three and seventeen of the said Act was deposited for public inspection, such special roll was not deposited within the time prescribed by the said section seventeen :

And whereas it appears that the ratepayers of the district have not been misled by such irregularity as aforesaid, and it is expedient to validate the same :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the said Act, and of all other powers and authorities enabling him in that behalf, and acting by

and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the said special roll had been deposited for public inspection within the time prescribed by the said Act, and that the validity of the proceedings in connection with the said loan, or of the security for the said loan, shall not be called in question by reason only of the irregularity aforesaid.

At the Government Buildings at Wellington, this 10th day of February, 1926.

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS the Wairoa County Council, acting under and in pursuance of paragraph (e) of section sixteen of the Local Bodies’ Loans Act, 1913, proposes to raise a loan of five hundred pounds for the purpose of forming Willow Flat Road :

And whereas the ratepayers’ consent given under paragraph (e) of section sixteen aforesaid is irregular in that a subscribing ratepayer has attested the signature of the other subscriber thereto :

And whereas the special order authorizing the raising of the loan is irregular in that the public notification of the time and place fixed for the confirmation of the said special order, although given four times, did not comply with the provisions of section ninety-nine of the Counties Act, 1920 :

And whereas it appears that the ratepayers have not been misled by the said irregularities, and it is expedient to validate the same :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings taken to raise the said loan shall be valid to all intents and purposes as though the ratepayers’ consent had been properly witnessed, and as though public notification of the special order had been correctly given, and that the validity of the proceedings in connection with the said loan shall not be called into question by reason only of the irregularities or defects aforesaid.

Vesting a Reserve in the Paeroa Borough Council.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of February, 1926.

Present:

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart for a site for municipal buildings : And whereas it is expedient to vest the said reserve in the Mayor, Councillors, and Burgesses of the Borough of Paeroa.

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by the fourth section of the Public Reserves and Domains Act, 1908, doth hereby declare that from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Mayor, Councillors, and Burgesses of the Borough of Paeroa, in trust for a site for municipal buildings.

ALL that area in the Auckland Land District, containing by admeasurement 18 perches, more or less, being Lot 27
